9. Bill 123 seeks to amend Article 2, Section 25-2-3(a) of Chapter 25 (Review and <br /> acceptance of applications); Article 5, Section 25-5-8(c) of Chapter 25 (Other <br /> regulations); Article 5, Section 25-5-57(c) (Other regulations); Article 5, <br /> Section 25-5-67(d) (Other regulations); and Article 5, Section 25-5-77(d) <br /> (Other regulations)to remove each instance of the term "ohana dwelling" and <br /> insert the term "accessory dwelling unit". <br /> 10. In addition to the definition articulated above and housekeeping measures, Bill <br /> 123 seeks to amend Article 6. Division 3. of Chapter 25, Ohana Dwellings to <br /> include the following: <br /> • Removes the term `Ohana Dwellings and inserts the term Accessory dwelling <br /> units. <br /> • Section 25-6-30 General Provisions, appicability: Changes proposed to this <br /> section include changing the existing infrastructure requirements for `ohana <br /> dwellings which include similar sewer requirements, reduced potable water <br /> supply requirements and eliminated fire protection and road access <br /> requirements. Potable water can be private,public, rain catchment(no annual <br /> rainfall requirement), or a private well so long as they meet DOH <br /> requirements. <br /> • Section 25-6-31 Eligibility for `ohana dwelling unit.Proposed amendments <br /> include replacing the title of the section to be labeled as Where permitted. <br /> Specifically, the amendment to this section allows for accessory dwelling <br /> units to be permitted on a building site within the RS, RD, RA, FA and A <br /> zoning districts. These are the same districts where `ohana dwellings are <br /> currently permitted with the addition of the RD district. Bill 123 proposes to <br /> further restrict accessory dwelling units on any building site within the State <br /> land use agricultural district shall be subject to agricultural requirements for <br /> farm dwellings as established by ordinance or by rule of the director, adopted <br /> pursuant to chapter 91, Hawai`i Revised Statutes. Lastly, accessory dwelling <br /> units must have final inspection and a certificate of occupancy before use as a <br /> dwelling. <br /> -3- <br />
