In addition to the above listed criteria,the Planning Commission shall also consider <br /> the criteria listed under Section 6-3(b)(5) (A) through (G). In considering the criteria, the <br /> Planning Director recommends the following: <br /> (A) Such use shall not be contrary to the objectives sought to be <br /> accomplished by the Land Use Law and Regulations. As mentioned previously, the <br /> subject properties have been cleared and developed with structures,parking and driveways <br /> associated with churches and/or educational purposes for several decades. The proposed <br /> new classrooms will be constructed on land that is not considered to have high agricultural <br /> potential from a resource perspective, due to the soil type and its low productivity rating. <br /> The property is not considered important agricultural land as its soils are classified as "C" <br /> or "Fair" and "E" or "Very Poor" for agricultural productivity by the Land Study Bureau <br /> Soil Classification System and are considered "other important agricultural land" by the <br /> Department of Agriculture's ALISH Map. <br /> As evaluated above, the applicant's request is considered an unusual and <br /> reasonable use of agricultural land that will not adversely affect the preservation of lands <br /> with high agricultural potential in the County of Hawaii. Thus, the establishment of the <br /> proposed use will not be contrary to the objectives sought to be accomplished by the State <br /> Land Use Law and Regulations. <br /> (B) The desired use shall not adversely affect the surrounding properties. <br /> Properties situated immediately adjacent to the subject properties are zoned Agricultural <br /> (A-5a and A-la) and Family-Agricultural (FA-2a), with uses consisting of residential <br /> dwellings, a church and vacant lands. The school has been in operation since 1992 and the <br /> Planning Department has no record of complaints about its operation nor has the <br /> Department received any opposition testimony from the public at the time of this writing. <br /> Based on the preceding it is not anticipated that the proposed use will adversely affect the <br /> surrounding properties. <br /> (C) Such use shall not unreasonably burden public agencies to provide <br /> roads and streets, sewers,water, drainage, school improvements, and police and fire <br /> protection. Access to the subject properties is from Palani Road, a County owned and <br /> maintained road with a 20-foot-wide pavement within a variable-width right-of-way. The <br /> -3- <br />
