April 10, 2024 <br />To: Hawaii County Council via <br />Planning Commission - <br />From: Cathy Sinclair <br />Kailua Kona <br />Regarding: SB 121 - Un-hosted TARS in Residential Areas - <br />Thank you for taking the time to reconsider the prior arrangement of <br />"grandfathering" un-hosted TARS in Residential Areas in Kona. I live with <br />a back fence line that is adjacent to such property at 75-5809 Kini Loop / <br />96740. Over the years, I have collected a documentation file of complaints, <br />notifications, photos and recordings that is an inch thick. My neighbors <br />have similar files as well. The activities at this rental are out of control <br />because there is no oversight. <br />The problem is compounded by the property having an owner who lives in <br />California and is largely not available to manage the property. When I have <br />a complaint of loud noise and unruly activity that I report to the owner <br />either it 1. is completely ignored, 2. negated by comments to quote "how <br />can that be", 3. or shifted back to the neighbor to speak to the tenant to <br />"work something out". This is all documented. The police now are the <br />overseers of the property and that is not their job. <br />This is a residential family neighborhood. Folks are largely in bed at 8:00 <br />pm and up at 5:30 am. Parties that go on all day and all night are a blight <br />to the peace and harmony that we all seek at home.
