The public access <br /> plan provides vehicular access to the subject property from Akoni Pule Highway,by way <br /> of access easements, and pedestrian trails provide access to the shoreline. The applicants <br /> received authorization from the owner of the access easements, Chalon International of <br /> Hawaii, Inc., on September 3, 2001 (Planning Department Exhibit 4—Letter from the <br /> Planning Department to Mr. Marc Melton). The applicant remains responsible for <br /> maintenance of the public access trails and all signs erected along or near the public <br /> access trails must be approved by the Planning Director. The applicant indicated that they <br /> currently maintain the public access trails with mowing and that members of the public <br /> regularly use the trails to access the shoreline for fishing and hiking recreation. By letter <br /> dated March 6, 2024,the Kohala Community Access Group (KCAG)proposed several <br /> amendments to the existing Declaration of Access and Utility Easements or recorded <br /> public access plan (DAVE). By letters dated April 8 and April 9, 2024, the applicant <br /> provided a draft of suggested amendments to the DAVE,pursuant to an agreement <br /> between the applicant and the KCAG. <br /> PUBLIC UTILITIES AND SERVICES <br /> 25. Access: Condition No. 6 of Special Permit No. 1117,now Condition No. 8, stated that <br /> access to the permit area from Akoni Pule Highway shall be other than Union Mill Road, <br /> rather via an access easement through either Kamehameha Park or near Union Market. <br /> The condition further required that the applicant improve the access drive,meeting with <br /> the approval of the Department of Transportation (DOT) and improve those portions of <br /> Pratt Road and the former cane haul road that provides access to the project site with a <br /> minimum 20-foot-wide compacted gravel surface,prior to the establishment of the <br /> proposed retreat. The applicant states that they have complied with this condition and the <br /> improved access drive has been designated with names,with the mauka portion named <br /> Maluhia Road and the makai portion named Lokahi Road. DOT-Highways Division <br /> reviewed the application and commented that the proposed project does not appear to <br /> significantly impact the State highway system. Additionally, DOT-Airports Division <br /> provided comments stating that the Federal Aviation Administration (FAA) will require <br /> -7- <br />
