From: Ramananda ACBSP <br /> To: LPCtestimony <br /> Subject: Concerns and Recommendations Regarding Bill 121 <br /> Date: Tuesday,April 16,2024 1:36:11 PM <br /> Chairperson Barbara Defranco Leeward Planning Commission County of Hawai'i <br /> 25 Aupuni St. Unit 1502 <br /> H i lo, H 196720 <br /> Aloha Chairperson Lin &Commission Members, <br /> I am writing to express my concerns about Hawaii Bill 121 and to recommend that the Leeward <br /> Planning Commission consider alternative approaches to address the issues it aims to solve. <br /> My testimony focuses on three main areas: enforceability, inequity, and the lack of data <br /> supporting the bill's provisions. <br /> Firstly,the enforceability of Bill 121 raises significant concerns.The bill's requirements, such <br /> as the affidavit requirement, place a heavy burden on homeowners and the Planning <br /> Department, potentially diverting resources from more critical issues. I urge the commission <br /> to recommend removing the affidavit requirement to alleviate this burden. <br /> Secondly, Bill 121 introduces inequity bytreating property owners and operators differently <br /> based on their living arrangements.This distinction could unfairly penalize those who <br /> contribute positively to our community and economy.Therefore, I request the commission to <br /> recommend equal treatment for all property owners and operators, regardless of their living <br /> situation. <br /> Lastly,the lack of comprehensive data on the impact of short-term rentals on affordable <br /> housing and the local economy is concerning.Without this data, it is challenging to assess the <br /> bill's potential effects accurately. I recommend that the commission advocate for an <br /> economic impact study and an affordable housing study to inform future decisions. <br /> Our community deserves regulations that are fair, enforceable, and based on solid data. I <br /> believe that by addressing these concerns,we can find a balanced approach that respects <br /> private property rights, supports our economy, and maintains the character of our <br /> neighborhoods. <br /> Mahalo for considering mytestimony.
