Merit Board of Appeals May 20, 2015 <br /> UNFINISHED The Chair directed the Board to proceed to the next order of business, <br /> BUSINESS (Item 7): Unfinished Business. <br /> STATUS UPDATE: COMMUNICATION 13-02.2, RECEIVED ON MAY 7, 2015, FROM <br /> TED H.S. HONG, ESQ., ON BEHALF OF HIS CLIENT, INFORMING THE BOARD THAT HE <br /> IS WITHDRAWING THEIR APPEAL CONCERNING AN INVOLUNTARY TRANSFER TO <br /> ANOTHER POSITION WITHIN THE DEPARTMENT OF PUBLIC WORKS <br /> (REFERENCE: COMM. NO. 13-02) <br /> Chair Rabago stated that this communication is withdrawing an internal complaint <br /> filed previously by an employee with the Public Works Department. No action is <br /> required by the Board. Mr. White confirmed that it be accepted as submitted. <br /> BOARD APPROVAL REQUIRED: COMMUNICATION NO. 15-15.2, RECEIVED ON MAY <br /> 12, 2015, FROM JULIAN T. WHITE, DEPUTY ATTORNEY GENERAL, TRANSMITTING <br /> THE FINDINGS OF FACT, CONCLUSIONS OF LAW AND ORDER CONCERNING <br /> COMMUNICATION NO. 15-15 APPEALING A CLASSIFICATION OR RECLASSIFICATION <br /> OF A PARTICULAR POSITION ACTION BY THE DEPARTMENT OF HUMAN RESOURCES <br /> At this time, Mr. White respectfully suggested to the Board that as a professional <br /> courtesy to the Counsels who are in attendance for another matter listed on the <br /> agenda,that their matter be taken out of order. There were no objections. <br /> CONSENT ITEM By general consent,the following item was taken out of order with no <br /> CHANGE ORDER OF objections from the Board Members. <br /> BUSINESS: <br /> BOARD ACTION REQUIRED (SETTING A HEARING DATE): COMMUNICATION NOS. <br /> 15-16 AND 15-17, RECEIVED ON MARCH 18 AND MARCH 30, 2015, RESPECTIVELY, <br /> APPEALING AN EMPLOYMENT ACTION BY THE FIRE DEPARTMENT(NOTE: AT ITS <br /> MEETING HELD ON APRIL 15, 2015,THE BOARD APPROVED COMMUNICATION NO. <br /> 15-16.1 REQUESTING THAT THE APPEALS CONTAINED IN COMMUNICATION NOS. <br /> 15-16 AND 15-17 BE CONSOLIDATED. ALSO,THE BOARD POSTPONED SETTING THE <br /> HEARING DATE TO ITS NEXT SCHEDULED MEETING); <br /> POSTPONED: APRIL 15, 2015 <br /> Chair Rabago stated this matter concerns setting a hearing date for the appeals <br /> regarding an employment action by employees of the Fire Department. Her <br /> thought is to have the hearing set in October as the Board would need to <br /> concentrate on the prior appeals filed, and doesn't want to rush this matter. She <br /> asked the Counsels for a status report (of their investigation). <br /> Page 3 <br />
