Management Area. Approval of this request is subject to the following conditions: <br /> 1. The applicant(s), its successor(s) or assign(s) shall be responsible for complying with all <br /> of the stated conditions of approval. <br /> 2. The applicant shall secure all necessary approvals and permits from other affected <br /> Federal, State, and County agencies as necessary to comply with all applicable laws and <br /> regulations. <br /> 3. Construction and operation of the proposed Punalu'u Village, and coastal preservation <br /> area shall be conducted in a manner that is substantially representative of plans and <br /> details as contained within the Special Management Area Use Permit application dated <br /> December 18, 2023, and representations made to the Windward Planning Commission. <br /> 4. Construction of the proposed development shall be completed within ten (10) years from <br /> the effective date of this permit. Prior to construction, the applicant shall secure Final <br /> Plan Approval for the proposed development from the Planning Director in accordance <br /> with Section 25-2-70, Chapter 25 (Zoning Code), Hawaii County Code. Plans shall <br /> identify all existing and/or proposed structure(s), paved driveway access, and parking <br /> stalls associated with the proposed development. Landscaping shall be indicated on the <br /> plans for the purpose of mitigating any adverse noise or visual impacts to adjacent <br /> properties in accordance with the requirements of Planning Department's Rule No. 17 <br /> (Landscaping Requirements) and Chapter 25 (Zoning Code), Hawaii County Code. <br /> 5. All driveway connections to Ninole Loop Road shall conform to Chapter 22, County <br /> Streets, of the Hawaii County Code. <br /> 6. All construction and maintenance activities on the subject parcel shall comply with <br /> Chapter 27, Floodplain Management, of the Hawaii County Code. <br /> 7. All earthwork and grading shall conform to Chapter 10, Erosion and Sedimentation <br /> Control of the Hawaii County Code. <br /> 8. The applicant will submit to the Planning Department for review and approval the <br /> following updated plans: 1) Water Quality and Marine Life Monitoring Plan, 2) Pond <br /> Management Plan, 3) Cultural Resources Management Plan, and 4) Shoreline and <br /> Preservation Area Management Plan. These plans shall be submitted prior to any <br /> development activities described in this permit. <br /> -14- <br />
