Ordinance 22-7 increases the minimum permissible <br /> rental period for residential properties on Oahu from 30 days to 90 days, with no <br /> provision, beyond a six-month phase out period, to accommodate existing 30 to 89 <br /> day rentals. Dkt. No. 60. HILSTRA seeks an order: (1) finding that Ordinance 22- <br /> 7 is preempted by Hawaii Revised Statutes ("HRS") § 46-4(a); and (2) invalidating <br /> Ordinance 22-7, or, in the alternative, permanently enjoining Defendants City and <br /> iHII,STRA is a nonprofit corporation with the mission of promoting a sustainable business <br /> environment for legal property rentals across the state of Hawaii. Complaint at¶ 9, Dkt. No. 1. <br /> Its members include property managers and owners who,prior to the effective date of Ordinance <br /> 22-7,participated in advertising and renting residential properties on Oahu for periods of at least <br /> 30 days.
