PROPOSED DEFINITIONS <br />5. Bill 121 proposes to amend Hawaii County Code Chapter 25 (Zoning Code) to <br />delete the definition of `Short-term vacation rentals' and to include definitions for <br />`Booking services', `Event', `Gathering', `Hosting platform', `Operator', <br />`Operator -hosted', `Owner -hosted', `Principal home', `Transient' or `Transients', <br />`Transient Accommodation', `Un -hosted', and `Verified complaint'. <br />WHAT IS A TRANSIENT ACCOMODATION? <br />6. `Transient accommodation' as defined in Bill 121 is, "...the furnishing ofa room, <br />apartment, suite, single family dwelling, or the like to a transient for less than one <br />hundred eighty consecutive days for each letting in a hotel, apartment hotel, <br />motel, or condominium or unit as defined in chapter 514B, cooperative <br />apartment, dwelling unit, or rooming house that provides living quarters, <br />sleeping, or housekeeping accommodations, or other place in which lodgings are <br />regularly furnished to transients. " The definition goes on to offer examples of <br />what transient accommodations exclude, which include, hotels, motels, inns; <br />apartment hotels; boarding facilities; lodges; and timeshares. <br />7. Bill 121 establishes three (3) types of transient accommodation rentals which <br />include the following: <br />• Owner -hosted is defined as "...any transient accommodation rental <br />hosted by a person who uses the building site as their principal home "; <br />• Operator -hosted is defined as "...any transient accommodation rental <br />hosted by an operator ". Bill 121 also defines an Operator as "...any <br />person operating a transient accommodation rental on behalf of a <br />property owner, who resides on the same building site as the transient <br />accommodation rental and uses it as their permanent address for legal <br />purposes "; and <br />• Lastly, Un -hosted is defined as "...any transient accommodation rental <br />that is not the principal home of the property owner and without an <br />operator located on the building site during rental operations". <br />-3- <br />
