3C. Institutional Considerations <br /> State Land Use <br /> The subject site is designated State Land Use Agricultural(Figure 5), and the Special Permit <br /> area consists of an approximately .5-acre portion of the parcel. As such, no State Land Use <br /> Commission action is required. The County of Hawaii can process the Special Permit request. <br /> As mentioned above,based on the Land Study Bureau Overall Master Productivity Rating, the <br /> subject property is classified as roughly half"D" (poor) and half"C" (acceptable) (Figure 7). <br /> Granting of this request would promote the effectiveness and objectives of Chapter 205, Hawaii <br /> Revised Statutes, as amended. In the case of the Agricultural District, the State Land Use Law is <br /> intended to preserve or keep lands of high agricultural potential in agricultural use. However, in <br /> recognizing that lands within agricultural districts might not all be best suited for agricultural <br /> activities and yet classified as such, and in recognition that certain types of uses might not be <br /> strictly agricultural in nature, yet reasonable in such districts, Hawaii Revised Statutes §205-6 <br /> allows County Planning Commissions to permit certain unusual and reasonable uses within the <br /> Agricultural and Rural districts other than those for which the district is classified. In this case, <br /> the requested use will be located within an existing dwelling and will be subordinate and <br /> incidental to the principal use of the property as the applicants' residence and farm. The majority <br /> of the remaining property will continue to be used for agricultural activities and thus the use will <br /> not displace existing agricultural activity or diminish the agricultural potential of the property. <br /> On the contrary, it will enhance our ability to care for it! Therefore, the use will not adversely <br /> affect the preservation and agricultural use of the property and is not contrary to the objectives <br /> sought to be accomplished by the State Land Use Law and Regulations. <br /> Special Management Area <br /> The subject property is approximately 3 miles inland from the coast and is outside of the <br /> designated Special Management Area. <br /> County Zoning and General Plan <br /> The subject property is zoned A-3a (Figure 5). The County General Plan Land Use Pattern <br /> Allocation Guide (LUPAG)map designates the parcel as Other important agricultural land <br /> (Figure 9). Relative to this designation, the General Plan allows consideration for a"Special <br /> Permit" on agricultural land where the requested use meets certain criteria as outlined in Section <br /> 4 of the permit application and Chapter 205 of the Hawaii Revised Statues as amended. <br /> General Plan Discussion <br /> The Hawaii County General Plan serves as a guide for decision-makers in land use matters. The <br /> proposed project is conducive to the General Plan's guidelines as it conforms to the following <br /> goals,policies, and standards of the General Plan: <br /> 19 <br />
