Refer to Planning Commission Rule 4-32 for <br /> appeal procedures. <br /> (g) Amendments to a Special Management Area Use Permit or Conditions <br /> (1) Application: The applicant may apply to the Commission through <br /> the Director for an amendment to the permit or condition(s)imposed <br /> by the Special Management Area Use Permit. <br /> In the case of time extensions,the applicant shall set forth in writing: <br /> (a) the length of time requested; and (b) the reasons for the time <br /> extension. <br /> In the case of additions, modifications, and/or deletions of <br /> conditions,the applicant shall file the request not less than sixty days <br /> prior to the expiration date of the time conditions, setting forth: (a) <br /> the condition to be amended; and (b)the reasons thereof. <br /> The applicant shall also deposit with the Department the sum of two <br /> hundred fifty ($250) dollars to cover publication and other <br /> administrative costs, along with the request. <br /> (2) Notice and Hearing: The hearing and notice procedures shall be the <br /> same as under Section 9-11(c) and (d). <br /> (3) Decision and Order: The procedures shall be the same as provided <br /> for under Section 9-11(f). <br /> 9-12 Artificial Light on Shoreline and Ocean Waters <br /> (a) Artificial light from floodlights, uplights, or spotlights used for decorative <br /> or aesthetic purposes is prohibited when the light(1)directly illuminates the <br /> shoreline and ocean waters; or (2) is directed to travel across property <br /> boundaries toward the shoreline and ocean waters. <br /> (b) Section 9-12(a) shall not apply to: <br /> (1) A outdoor lighting fixture that is located on the grounds of a <br /> hotel/hotel-condo, provided that (A) the outdoor lighting fixture is <br /> located underwater or is directed downward and illuminates a <br /> limited area of no more than thirty feet into the shoreline and ocean <br /> waters; or (B) the outdoor lighting fixture is the only practicable <br /> 9-20 <br />
