The Planning Department can calculate and provide the maximum zoning <br /> density that can be developed for a property but has no way of predicting what use or <br /> buildings will be developed. <br /> PLANNING DIRECTOR'S RECOMMENDATION <br /> Since the introduction of Bill 134, the Planning Department has tried to gain an <br /> understanding of the intent and purpose of Bill 134. The Planning Director convened with <br /> the initiators of the bill to discuss its purpose. During the meeting, the Director conveyed <br /> that meeting the information requirements outlined in Bill 134 would be unfeasible as <br /> described in the example above. Based on the preceding, Bill 134, as currently written, is <br /> too general, leading to varying interpretations and implementations. <br /> However, in response, the Director proposed alternative approaches to furnish the <br /> Council with as much pertinent information as feasible. <br /> In considering alternative approaches, the Planning Director recommends that the <br /> bill be re-written to strike a balance between the necessity for comprehensive evaluation <br /> of surrounding properties and the practical constraints and resource limitations. Some <br /> suggested strategies include: <br /> 1. Targeted Analysis: <br /> Concentrate on properties within a smaller radius or those most likely to <br /> undergo development, thereby streamlining the report's scope and complexity. <br /> Preparing such detailed reports for such a large radius for each change of zone <br /> application would require significant time and labor and is redundant with the <br /> existing planning process. As an example, staff compiled a list of surrounding <br /> properties for TMK: (3) 8-1-008:004 and (3) 2-2-035:096 that are within a <br /> 500-foot radius and focused on zoning districts that are more complex than the <br /> Residential District. This type of analysis took staff approximately 4 hours to <br /> complete. (Planning Department—Exhibit 3) <br /> -4- <br />
