shoreline, is not within the Special Management Area and will not be impacted by coastal <br /> hazard and beach erosion.There is no designated public access to the mountain or shoreline <br /> areas over the property. As such, the proposed use will not adversely impact any <br /> recreational resources, including access to and along the shoreline, scenic and open space <br /> nor visual resources, coastal ecosystems, and marine and coastal resources. Therefore, the <br /> proposed use is not contrary to the objectives of Chapter 205A, Hawaii Revised Statutes. <br /> The request will not have a significant adverse impact to traditional and <br /> customary Hawaiian Rights.In view of the Hawaii State Supreme Court's"PASH" and <br /> "Ka Pa`akai O Ka`Aina" decisions, the issue relative to native Hawaiian gathering and <br /> fishing rights must be addressed in terms of the cultural, historical, and natural resources <br /> and the associated traditional and customary practices of the site. <br /> Investigation of valued resources: No commissioned archaeological studies were <br /> conducted for the project area as the site has been fully cleared and has been previously <br /> graded. Additionally, the most recent lava flow to cover the site occurred in 1907, thus it <br /> is unlikely that historic or archaeological sites are present on the property. <br /> The valued cultural, historical, and natural resources found in the special permit <br /> area: According to the applicant, no known archaeological sites, historical, or cultural <br /> resources are known to be located on the property. It is not known whether the subject site <br /> or immediate area was ever used for traditional and customary rights by native Hawaiians. <br /> The property is completely cleared and graded, so there are no endangered or listed <br /> floral species found on the property. Faunal species are primarily introduced bird species, <br /> domestic and feral animals,none of which are listed or endangered. <br /> Possible adverse effect or impairment of valued resources: Native plants and/or <br /> endangered species are unlikely to be impacted by the proposed development due total <br /> clearing and grading of the subject property.However,given the possibility of listed faunal <br /> species within the area, a condition of approval will require the applicant to comply with <br /> DOFAW recommendations for mitigating impacts on species if they are found to be <br /> present. <br /> -9- <br />
