There is no record of a Special Use Permit being issued for the subject property. <br /> NOTICE <br /> This letter serves as a warning that there may be a violation of Chapter 25, Hawaii County <br /> Zoning Code on your property. We want to give you the opportunity to disprove the <br /> complaint or take necessary corrective action listed below. To respond to the complaint, <br /> you must do one of the following by the "Deadline Date" of October 17, 2022. <br /> If you are not operating a non-agricultural activity as defined above,then do the <br /> following: <br /> 1. Provide a written letter to our office by the "Deadline Date" (Attention to: Ms. <br /> Elizabeth Gillis, Planning Inspector) with a statement that you are not operating a <br /> Church on the subject property. <br /> 2. Contact our planning inspector, Ms. Elizabeth Gillis to arrange a date and time <br /> prior to the deadline date to have the property inspected to verify compliance. <br /> Upon receipt of your letter and after our satisfactory review we may close the complaint <br /> process with no formal action depending on the evidence that you provide to this office. <br /> If you are operating a non-agricultural activity as defined above, then do the following: <br /> 1. Provide a written letter to our office by the "Deadline Date" (Attention to: Ms. <br /> Elizabeth Gillis, Planning Inspector) with a statement that you have stopped the <br /> non-agricultural activity on the property. <br /> 2. Immediately cease using the property as a Church. <br /> 3. Apply for a Special Use Permit if you intend to operate non-agricultural activities, <br /> Church, in the future. <br /> 4. Contact our planning inspector, Ms. Elizabeth Gillis to arrange a date and time <br /> prior to the deadline date to have the property inspected to verify compliance. <br /> Upon receipt of your letter and after our satisfactory review we may close the complaint <br /> process with no formal action depending on the evidence that you provide to this office. <br /> GENERAL INFORMATION <br /> What happens if you do not correct the alleged violation? <br /> If your letter is not received by the "Deadline Date" listed above, then your property will <br /> be further investigated and the observations evaluated; if a violation is determined to exist, <br /> you will be issued a "Notice of Violation and Order" where an Initial Civil Fine along with <br /> daily fines will be assessed, and legal action may be taken against you. <br />
