Special Management Area. It is located approximately 3.9 miles from the nearest <br /> coastline and will not be impacted by coastal hazard and beach erosion. There are no <br /> identified recreational resources, historic resources,public access to the shoreline or <br /> mountain areas, scenic and open space preserves, coastal ecosystems, marine resources, <br /> or other natural and environmental resources on the subject property. <br /> The request will not have a significant adverse impact to traditional and <br /> customary Hawaiian Rights. In view of the Hawaii State Supreme Court's "PASH" <br /> and"Ka Pa'akai O Ka`Aina" decisions, the issue relative to native Hawaiian gathering <br /> and fishing rights must be addressed in terms of the cultural, historical, and natural <br /> resources and the associated traditional and customary practices of the site. <br /> Investigation of valued resources: Given the extensively altered condition of the <br /> rezone are due to its former use as sugarcane land and its recent use as a nursery with the <br /> cultivation of commercial dracaena, rhapis palms, and avocado trees on most of the <br /> property, no formal archaeological reconnaissance survey, oral history of kama`aina <br /> accounts of the area, historical survey of documentary records or floral/faunal studies <br /> were included in the applications. <br /> The valued cultural, historical, and natural resources found in the rezoning area. <br /> In response to a 2023 grubbing permit application for the rezone area, the State Historic <br /> Preservation Division (SHPD) determined that no historic properties would be affected <br /> by proposed grubbing due to previous ground disturbing activities associated with land <br /> clearing and agricultural activities. <br /> Given the rezone area's previous ground disturbance and historical agricultural <br /> uses, it is unlikely that there are any threatened or endangered plant or animal species <br /> located thereon. However, according to the State Division of Forestry and Wildlife <br /> (DOFAW), it is possible that threatened or endangered species (e.g., Hawaiian Hoary bat, <br /> Hawaiian Hawk, Hawaiian Short-eared Owl, and migratory seabirds could traverse or be <br /> found within the rezone area. <br /> Possible adverse effect or impairment of valued resources: There is no evidence <br /> of any possible adverse effects or impairments will occur to any valued historic, <br /> archaeological, or cultural resources within the rezone area. <br /> -7- <br />
