The Public Access, Open Space and Natural Resources Preservation Commission
has been in existence for a little more than a year. During this time, a prioritized list of
qualifying lands worthy of preservation was prepared and submitted for your comments
and recommendations. The commissioners note that there has been much public interest
in the work of the commission and the process of land acquisition by the County. The
members of the Public Access, Open Space and Natural Resources Preservation
Commission want to say "thank you" to you, your staff and the County Council members
for initiating acquisition of some of the recommended properties.
Pursuant to Section 2- 217(2) of the Hawaii County Code, requires the Hawaii
County Public Access, Open Space and Natural Resources Preservation Commission to
update the prioritized list at least annually by December 31 of each year. The attached
report contains the updated prioritized list and also describes the revised process that was
used to update the list.

Introduction
Pursuant to Section 2 -217 of the Hawaii County Code, 1983 (2005 Edition), (see
Attachment 1), the Hawaii County Public Access, Open Space, and Natural Resources
Preservation Commission is submitting this 2006 Annual Report and the Prioritized List -Land
and/or Property Entitlements for Acquisition (December 27, 2006) (hereinafter referred to as the
"Prioritized List ") to the Mayor. (See Attachment 2). The Prioritized List is an island -wide
listing based on public input and the Commission's evaluation of the merits and urgency for
acquisition of the various properties submitted.
Since the submittal of the Commission's initial report and prioritized list (dated April 5,
2006), several properties from this list have been strongly considered by the County for
acquisition through the Public Access, Open Space, and Natural Resources Preservation Fund.
Consequently, resolutions from the County Council were adopted that authorized the
Administration to enter into negotiations for the acquisition of parcels at the Waipi`o Lookout
Point (Resolution No. 427 -06), Kawa`a (Resolution No. 451 -06) and Punalu`u Beach Park and
Adjacent Lands (Resolution No. 452 -06). In addition, a resolution was passed pertaining to the
preservation of numerous historic and cultural sites located on the Puapua`a parcel (Resolution
a No. 404 -06). Likewise, the Mayor, Administration, and County personnel have been working
diligently in accomplishing the potential acquisition of the afore - mentioned properties as
previously identified by the Commission.

Commission Meetings
OSince the submittal of the initial report in April 2006, the Commission conducted
monthly meetings alternating between Hilo and Kona and received additional suggestion forms
and testimony from the public. Also during these meetings, the Commission engaged in

discussions with the Mayor, Planning Director, Finance Director, Department of Parks &
a Recreation Director, Corporation Counsel, and other County personnel pertinent to its functions
and duties. The Commission also invited Beryl Blaich, Vice -Chair of Kauai County's Public
Access, Open Space, and Natural Resources Preservation Commission, and Dave Caylor, Kauai
a Planning Department Planner, to share their experiences and progress with the similar
Commission on their island. In addition, other guest presenters included Dr. Brian Szuster
(re: Hawaii Coastal & Estuarine Conservation Plan), Josh Stanbro (re: Trust for Public Lands),
a and Debbie Hecht (re: Save our Lands Citizen Committee & 2% Initiative). The following list
outlines the meetings that were scheduled:

Revision of Assessment Criteria Form
The assessment criteria form used in the initial report was streamlined and revised to
reflect criteria that could be adequately assessed by Commission members with the information
at hand. As a result, Criteria 5 & 6, were deleted from this form because it was felt that this type
of information was generally not available unless further research or a due diligence report was
completed for each property. In addition, Criteria 2 was revised so that the scoring would be
more balanced and would correlate with the five designated purposes of the fund. Otherwise,
Criteria 1, 3, and 4 remained relatively the same with just a few changes in the wording. This
revised 2007 Assessment Criteria Form (see Attachment 3) was used in updating the Prioritized
aList for this 2006 Annual Report and will also be utilized in 2007.
aRevision of Suggestion Form
The suggestion form was also revised to include additional questions and requests for
supplementary information and documentation relating to the suggested site or project. Based
upon the recent review of the process used by Commission members in compiling the initial
prioritized list, it was felt that there was often insufficient information to make adequate
assessments. In addition, the suggestion form format was also revised so that it would correlate
with the revised assessment criteria form. This revised suggestion form will be utilized in 2007.
For purposes of this 2006 Annual Report, the former 2006 suggestion forms were used.

Updating Prioritized List
aIn updating the Prioritized List_ for this 2006 Annual Report, the Commission assessed the
suggestion forms received between February 11, 2006 and September 5, 2006. There were a
a total of 12 suggestion forms that were received during this time period. The Commission
assessed these properties utilizing the revised 2007 Assessment Criteria Form (see Attachment
3). In addition, the top twelve properties from the previously submitted "Properties and/or
a Entitlements for Purchase List" (April 5, 2006) were reexamined and reassessed with this revised
2007 Assessment Criteria Form.
The properties that had a criteria score of 80% or higher were included in this year's
evaluation process for the Prioritized List.
a The Comprehensive List (December 27, 2006), which includes all of the aforementioned
properties that were assessed. with the revised 2007 Assessment Criteria Form is included as
Attachment 4. In addition, the previously submitted Comprehensive List (April 5, 2006) is
included as Attachment 5.
Next Steps
aThe Commission has developed a timeline for 2007 to accomplish the following tasks:
• Implement publicity strategy for soliciting suggestion forms for 2007
a• Schedule next round of regional public meetings
• Consider site visits as a part of the Commission's process
• Explore other funding sources for land/entitlement acquisitions
• Identify potential partnerships with other government agencies, non - profit
organizations, and/or private entities for land/entitlement acquisitions
a• Submit annual report and updated prioritized list by December 31, 2007

n§ 2 -217 HAWAII COUNTY CODE
Section 2 -217. Duties and responsibilities of the commission.
The duties and responsibilities of this commission are:
(1) To develop and submit to the mayor, an initial island -wide prioritized list of qualifying lands
worthy of preservation within six months of being confirmed to the commission by the council.
Priorities shall be listed on an island -wide rather than district basis. The list shall include the
significance of each parcel or entitlement identified, the reason for its priority, and its anticipated
a use after acquisition;
(2) To update this list at any time, but at least annually by December 31 of each year; and
(3) To explore methods of funding land acquisition and make recommendations t' the mayor.
(4) The commission shall give emphasis to land acquisitions where the County's contribution can be
a leveraged to obtain State, Federal, and/or private funds.

Section 2 -218. Prioritized list of qualifying lands worthy of preservation.
(a) The prioritized list developed by the commission shall be submitted to the mayor for comments and
recommendation. Within sixty days after receipt, the mayor will submit the list to the council with
a comments and recommendations. The council shall, by resolution, select the land or lands to be
preserved. Under no circumstances shall the purchase price paid for a property exceed the appraised
value as prepared by an independent appraiser engaged by the County. Where there are multiple lands
under consideration at any one time, priority shall be given to coastal lands and lands where matching
funding is available to leverage the County contribution.
(b) Negotiations for acquisition of lands to be preserved shall occur between the County and the seller or its
commissioned agent, or a licensed broker only. The commission shall have no role in the negotiations
a other than in its advisory capacity.
(c) Appraisals, title reports, surveying and other costs incidental to the acquisition of land shall be permitted
uses of this fund. These costs shall be allocated equally between the seller and the buyer.
(d) Adequate staff to carry out the provisions of this article and to manage the land acquired shall be
provided in the department of finance to maximize the use of available funds by minimizing the payment
of commission to outside agents to put together funding plans and to ensure that the County is a good
steward of any land that comes under its control through this article.

aArticle 43. Budget Stabilization Fund.
Section 2 -219. Creation of fund.
a Pursuant to section 10 -12, Hawaii County Charter 2000, a special fund to be known as the budget
stabilization fund is created for the purpose of meeting general fund revenue shortfalls and to minimize the
need for budget cuts or tax increases. The budget stabilization fund shall be a temporary supplemental source
of funds for the County to use during times of financial hardships while a plan for cost reduction or revenue
enhancement is developed.

Section 2 -220. Funding.
Each fiscal year following the creation of the budget stabilization fund, moneys shall be transferred to this
fund as recommended by the mayor and approved by the council.
