Commissioner Van Pernis stated that he had as an attorney represented Applicant Mr. Rabin in a variety of matters years ago, and that he considered Mr. Rabin a friend. He recused himself from this agenda item for the reason that his relationship with the applicant would prevent him from being fair and impartial, Chairman Vitousek accepted his recusal.
