H. The proposed use shall not have any substantial adverse environmental or <br /> ecological effect, except as such adverse effect is minimized to the extent practicable and clearly <br /> outweighed by public health, safety or compelling public interests. Such adverse effects shall <br /> include, but not be limited to, the potential cumulative impact of individual developments, each <br /> one of which taken in itself might not have a substantial adverse effect, and the elimination of <br /> planning options, §205A-26(2)(A) Hawaii Revised Statutes, as amended. <br /> I. The proposed use shall be consistent with the objectives,policies and special <br /> management area guidelines of this chapter and any guidelines enacted by the legislature, <br /> Section 205 A-26(2)(B) of the Hawaii Revised Statutes, as amended. <br /> J. The proposed use shall be consistent with the general purpose of the zoning <br /> district, the intent and purpose of the Zoning Code and the County General Plan,pursuant to <br /> Section 205 A-26(2)(C) of the Hawaii Revised Statutes, as amended. <br /> K. The Commission should seek to minimize, where reasonable any development <br /> which would adversely affect water quality, existing areas of open water free of visible <br /> structures, existing and potential fisheries and fishing grounds, wildlife habitats or potential or <br /> existing agricultural uses of land,pursuant to Section 205 A-26(3)(E) of the Hawaii Revised <br /> Statutes, as amended. <br /> L. At the September 5, 2024 hearing, the Commission voted 5-0 to deny the <br /> Applicant's application for a Special Management Use Permit. The Commission's denial is <br /> based on the following mixed findings of fact and conclusions of law. <br /> M. The State Land Use Designation is Urban. The Land Use Pattern Allocation <br /> Guide (LUPAG)Map component of the General Plan is a representation of the document's goals <br /> and policies to guide the coordinated growth and development of the County.
