If not needed, explain why. <br /> The entire Wai'ele properties exist within Hawaii County's Special Management Area, thus <br /> requiring "all uses, activities or operations" to be assessed. HER will accordingly apply for a <br /> Special Management Area Use Permit. A close reading of Chapter 205A (Coastal Zone <br /> Management) indicates that all of the proposed uses, activities, or operations are outside the <br /> definition of"development." However, because HER's "invasive vegetation removal or control" <br /> strategy includes the use of herbicides, it is possible that activity may be determined an unpermitted <br /> use. In that scenario, HER is prepared to adjust its tactics to exclude use of herbicide in the <br /> removal of invasive vegetation. <br /> A narrow strip of coastal Wai'ele is in the State Consevation District Resource Subzone. None of <br /> the proposed uses of that area are mentioned in HAR§13-5-24, thus a permit is not required for <br /> these uses. <br /> As far as NEPA law, because conservation/preservation activities will be conducted using funds <br /> that flow from the County, it is possible that a permit, approval, or exemption is required. Since all <br /> PONC stewardship proposals share this concern, HER looks forward to PONC and Corporate <br /> Counsel guidance on this matter. <br /> Ryan Perroy of the UH Hilo SDAVL is extremely knowledgeable about helicopter and drone <br /> regulations.
