E. STIPULATIONS. Except as otherwise provided by law, any of the foregoing <br />procedures may be modified or waived by stipulation of the parties and informal <br />dispositions may be made of any contested case by stipulation, agreed settlement, <br />consent order, or default. <br />F. JUDICIAL REVIEW. Judicial review shall be as provided by law. <br />RULE 1-7 PROTESTS. No protest against the granting of a liquor license shall be considered <br />by the Commission unless such protest is filed in accordance with this rule. <br />A. Oral or written protests shall be filed with the Commission at or before the <br />preliminary hearing and/or the public hearing. <br />B. The protest shall designate the application for which the protest is being filed. <br />C. Each person whose written protest is to be considered shall date, print name and <br />sign such protest. Separate signatures are required for each spouse, co-owner or <br />co -lessee filing a protest. Protests by owners or lessees of real estate or owners of <br />record of shares in a cooperative apartment shall include the tax map key(s) and <br />unit number(s), when applicable, on the letter or petition of protest. <br />D. The protest shall contain the name and address of each person submitting a <br />protest. <br />E. Each person submitting a protest shall indicate whether such person is a registered <br />voter for the area within five hundred feet of the nearest point at which the <br />applicant proposes to establish or continue the business under the license applied <br />for, or whether such person is an owner or lessee of record of real estate, or is the <br />owner of record of shares in a cooperative apartment situated within a distance of <br />500 feet from the nearest point of the premises for which a license is asked, or <br />both. <br />F. A protest filed by a person who is not a property owner or is not a registered voter <br />within 500 feet of the proposed licensed premises shall indicate the nature of the <br />protestor's interest. These protests shall not be included in the calculation of a <br />40 percent protest affecting an automatic refusal pursuant to Section 281-39.5, <br />Hawaii Revised Statutes, as amended, or in the calculation of a majority protest <br />affecting an automatic refusal of an application pursuant to Section 281-59, <br />Hawaii Revised Statutes, as amended. <br />G. When a protest against an application for a liquor license is duly filed by a <br />property owner who owns more than one parcel of real estate within 500 feet of <br />the proposed licensed premises, such protest shall be applicable and counted for <br />each parcel held within 500 feet of the proposed premises. <br />H. When the property within 500 feet of the proposed premises is held by a trust, <br />protests may be filed by the named trustee of record. <br />N. <br />
