provide an accountable mailing form or like document verified by the United <br />States Postal Service. The publication of notice and notice provided to interested <br />parties shall state the name and address of the petitioner, a statement of the <br />position or contention of the petitioner, and the date, time and place of the <br />hearing. The petitioner shall deposit a fee equal to the cost of publication of <br />notice and notice to other persons affected by said petition. <br />E. If the Commission decides to refuse a petition for rehearing, it shall issue an <br />appropriate Findings of Fact, Conclusions of Law and Decision and Order. The <br />Commission shall, within a reasonable time, send a certified copy thereof to the <br />petitioner. <br />F. A petition for rehearing by an applicant whose application has been refused <br />pursuant to (1) protests filed by the majority of property owners within 500 feet of <br />the nearest point of the premises or by the majority of registered voters within 500 <br />feet of the nearest point of the premises, or (2) protests filed by 40 percent of <br />owners or lessees of record of real estate, or owners of record of shares in a <br />cooperative apartment or by 40 percent of the registered voters within a distance <br />of 500 feet from a private elementary, intermediate or high school or public <br />playground utilized extensively by minors, shall be restricted to facts or grounds <br />which are directly related to the protests filed and/or its verification thereof as <br />provided in Section 281-59, Hawai`i Revised Statutes, as amended. <br />G. Any interested person aggrieved by the decision of the Commission may file a <br />petition for rehearing and shall file said petition within 15 days from the date of <br />the decision, provided that such interested person shall have been a participant of <br />record in the public hearing process of the application. The petition for rehearing <br />shall be filed in the form and substance as contained in this rule. <br />RULE 1-10 PUBLIC INFORMATION. The public may obtain information as to matters within <br />the jurisdiction of this Commission by inquiring at: <br />A. The office of the Lieutenant Governor of the State of Hawaii where there are on <br />file all rules of the Commission; or <br />B. The office of the Clerk of the County of Hawaii where there are on file all rules <br />of the Commission; or <br />C. The office of the Department, where all rules, order, forms, permits or opinions of <br />the Commission are available for public inspection. Copies of documents are <br />available to the public at a price to be fixed by the Department or the County to <br />cover mailing and publication costs. <br />D. Pursuant to Chapter 92F, Hawaii Revised Statutes, as amended, any person may <br />inspect public records. Such inquiries may be made in person at the Department <br />during regular business hours, or by submitting a request for information in <br />writing to the Department.
