RULE 1-14 FILING COMPLAINTS. Any aggrieved party may file a complaint with the <br />Commission relative to any provision of the license or a permit, provided that such <br />complaint shall be within the jurisdiction of the Commission in accordance with <br />Chapter 281, Hawaii Revised Statutes, as amended, and the rules. When a complaint <br />may result in a violation of liquor law, the complaint may be referred to the <br />Department for action. <br />The complaint shall be in writing and filed at the office of the Department and shall <br />indicate the name of the licensed premises, the nature of the complaint together with <br />any other facts for consideration by the Commission. The Commission shall conduct <br />a hearing in accordance with Chapter 91 of the Hawaii Revised Statutes, as <br />amended, and disposition of such complaint shall be in accordance with the powers <br />and jurisdiction granted to the Commission. <br />RULE 1-15 CAUSE FOR DISCIPLINE. Any act contrary to Chapter 281, Hawaii Revised <br />Statutes, as amended, the Rules and Regulations of the Liquor Commission, or a <br />Decision and Order of the Liquor Commission or the Liquor Control Adjudication <br />Board, whether committed on or off the licensed premises, which is directly related to <br />the business of the licensed premises, shall be cause for hearing before the <br />Commission or Adjudication Board. Upon a proper hearing thereof, a licensee shall <br />be subject to disciplinary action in accordance to law. <br />RULE 1-16 HEARINGS, AMENDING CONDITIONS. <br />A. Where the Commission has placed conditions on a license or permit, the licensee <br />or interested party of record may file an application to the Commission to amend <br />such conditions. No application shall be accepted until one year after the <br />effective date of the Commission's original decision. <br />B. The application shall be in writing and submitted in 12 copies and shall contain: <br />1. The name, address and telephone/facsimile number of the licensee. <br />2. A statement of the current condition imposed by the Commission. <br />3. A statement of the proposed request, together with any facts or evidence in <br />support of such request. <br />4. A memorandum of authorities, containing a full discussion of the reasons, <br />including any legal authorities, in support of such position or contention. <br />5. The signature of the applicant. <br />C. The Commission may reject the application when there is no new evidence to <br />support the request or when the application does not conform to the foregoing <br />requirements. <br />D. Upon acceptance of the application to amend a license or condition, the <br />Commission shall fix a day for a public hearing and may set forth the conditions <br />of notice and publication. <br />15 <br />
