All manufacturers shall keep separate and distinct records of account wherein <br />shall be entered the name of the licensee, license number, place of business, the <br />day, month and year in which the sale is made and the quantity and price of liquor <br />sold to each licensee. It shall be unlawful for any holder of a manufacturer's <br />license to acquire or hold any interest whatsoever in the license or licensed <br />premises of any other license. This subsection shall not prevent the holder of a <br />manufacturer license under this chapter or under the law of another jurisdiction <br />from maintaining any interest in the license or licensed premises of a wholesale <br />dealer licensee under this chapter. <br />A manufacturer of beer or wine or other specified liquors who conducts retail <br />sales to persons for private use and consumption shall be required to have an <br />authorized person in active charge of the premises on duty pursuant to Rule 5-2. <br />C. CLASS 2. RESTAURANT LICENSE. <br />1. A license under this class shall authorize the licensee to sell liquors herein <br />specified for consumption on the premises, except that a restaurant licensee <br />may provide off premises catering which shall permit the licensee to provide <br />liquor for sale and consumption at the catered premises while performing food <br />catering functions. The catering activity shall be directly related to the <br />licensee's operation as a restaurant provided that the Director shall be <br />authorized to establish the perimeter and consumption area for the catered <br />premises for the sale, service and consumption of liquor. The licensee shall <br />obtain a certificate of approval from the Director for each catering function in <br />accordance with the pertinent provisions of Rule 3-1-N-2. <br />A licensee who fails to meet the requirement where 30 percent of the <br />establishment's gross revenues of food and liquor are derived from food sales <br />shall be prohibited from catering liquor off premises until such time that said <br />requirement has been re-established. <br />A licensee under this class shall also authorize the licensee to sell beer, malt <br />beverages, or cider for off -premises consumption; provided that the licensee <br />has the appropriate kind of license; and provided further that the beer, malt <br />beverage, or cider is sold in a securely sealed or covered glass, ceramic, or <br />metal container that is sold to or provided by the patron, and each sealed or <br />covered glass, ceramic, or metal container does not exceed a maximum <br />capacity of one half -gallon. <br />A licensee under this class shall be issued a license according to the category <br />of establishment the licensee owns or operates. The categories of <br />establishment shall be as follows: <br />A. A standard bar: premises in which recorded music is permitted. <br />B. A premises in which live entertainment or recorded music is provided <br />and/or facilities for dancing by the patrons may be permitted as <br />provided in the subcategories listed herein: <br />21 <br />
