RULES AND REGULATIONS OF THE LIQUOR COMMISSION <br />OF THE DEPARTMENT OF LIQUOR CONTROL OF THE <br />COUNTY OF HAWAI`I, STATE OF HAWAPI <br />Pursuant to and by virtue of the authority set forth in Chapter 281 and Chapter 91 of the Hawaii <br />Revised Statutes, as amended, and Article VII, Chapter 3, and Section 13-7 of the Charter of the <br />County of Hawaii, the Liquor Commission of the Department of Liquor Control of the County of <br />Hawaii, State of Hawaii, adopts the rules and regulations of the Liquor Commission as hereafter <br />provided. <br />Part 1. RULES OF PRACTICE <br />RULE 1-1 DEFINITIONS. Words used in these rules and regulations in the singular, include <br />the plural, and vice versa; words of any gender include any other gender. Words <br />defined in Section 281-1 of the Hawaii Revised Statutes, as amended, shall have the <br />same meaning wherever used herein. <br />"Adjudication Hearing" means a proceeding held pursuant to Section 281-91, <br />Hawaii Revised Statutes, as amended, in which it is proposed to revoke or suspend <br />any license issued, or assess and collect a penalty, or reprimand a licensee. The <br />summary revocation of any special license is not included within the scope of this <br />term. <br />"Ambient Noise" means the totality of sounds in a given place and time, independent <br />of the sound contribution of the specific source being measured. <br />"Applicant" means a person who has filed any application for liquor license, <br />management agreement, permit or its like, for consideration by the Director or <br />Commission. <br />"Application" means the application or the required forms used in making the <br />request and any information contained therein for a liquor license, renewal or transfer <br />thereof, permit or the amendment of conditions placed on a license or a permit or any <br />other request or petition, and any other forms or documents which may be prescribed <br />from time to time by the Commission. <br />"Authorized Agent" means a person who is authorized in writing or in person by the <br />licensee or applicant to act for or be the representative of the licensee or applicant in <br />Commission or Board proceedings. <br />"Bartender" means a person who prepares or mixes alcoholic drinks in accordance <br />with established recipes and procedures. <br />"Board" means the Liquor Control Adjudication Board of the County of Hawaii. <br />
