Is it —because it's my understanding the position has <br />and I apologize for my ignorance in all of these human resources terms that I'm not fully <br />understanding of —but the classification/reclassification is what is checked off. <br />CHR. CABANAS: Correct. <br />MS. TAVARES: So, is it that that's what we're proceeding on because it doesn't appear to be <br />the issue. <br />CHR. CABANAS: That's what the Appellant's appeal is based on. <br />MS. TAVARES: <br />Okay. <br />CHR. CABANAS: <br />Yeah. The Appellant is in that position. <br />MS. TAVARES: <br />Correct —but my question isis the Appellant opposing that reclassification — <br />that's what is very <br />vague and it's void in all of the documents that were presented —like, is that <br />what the issue is? <br />MR. WISEMAN: <br />Madam Chair, if I may? <br />CHR. CABANAS: <br />Yes, Mr. Wiseman. <br />MR. WISEMAN: <br />Yeah. Ms. Tavares, it would be subject to a motion to dismiss. <br />MS. TAVARES: <br />Yes. <br />MR. WISEMAN: <br />It's almost touching on the merits. <br />MS. TAVARES: <br />Okay, that's fine. I just wanted to see if I can get that from the Appellant but I <br />understand. <br />MR. WISEMAN: <br />You can raise all those things in the motion. <br />CHR. CABANAS: Yes. And then, both of you will be submitting your documents. <br />MS. TAVARES: Right. <br />CHR. CABANAS: So, you'll be able to assess as those documents are submitted. But, again, <br />the merit of the case will be at the August 12'h hearing. Mr. Wiseman is correct. <br />MR.
