Merit Appeals Board May 24, 2024 <br />MS. TOKIHIRO: Sorry, I'm going to go back to my office if that's all right? <br />CHR. CABANAS: Yes, thank you. Yes, you may be excused, Sommer. <br />MS. TOKIHIRO: Yeah, thank you. But before I do —so I just wanted to thank Mr. Wiseman for <br />his service on the Board. I understand that this is your last meeting, but I just wanted to say, <br />"thank you" and it was a pleasure interviewing before you and then also getting to work with you <br />in these last few months. <br />MR. WISEMAN: Thank you for that I appreciate it. <br />MS. TOKIHIRO: Thank you. <br />MR. WISEMAN: Thank you. <br />CHR. CABANAS: Thank you, Sommer, for your reports today. <br />MS. TOKIHIRO: Thank you —bye-bye. <br />Unfinished Business (Item 7) <br />Discussion Concerning The Appeal Process And Providing A Fact Sheet For Individuals <br />Who File An Appeal (Note: The Above Matter Was Listed On The Following Agendas: <br />October 25 And December 21, 2023; February 23, March 12, April 25, And May 3, 2024.) <br />CHR. CABANAS: Okay. So, we are now on "Unfinished Business" for discussion and <br />appropriate action. The discussion concerning the appeal process and providing an informational <br />sheet for individuals who file an appeal. <br />We have the informational sheet for appeal hearing process and the input that was provided, as <br />we requested of Amanda Donlin, the Supervising Deputy Attorney General —and she did make <br />one notation, if you can look at your informational sheet. <br />MS. MATHEWS: On that same page, why do we have a blank bullet? <br />CHR. CABANAS: Because if you look at the track changes on the previous document, we lined <br />out "Strict rules of evidence will not apply." So, when we finalize it, Glynis will move it up. <br />So, let's look at Amanda's —on the second page, look at what's highlighted where it says, "The <br />County has the same opportunity to make a brief opening statement but may waive doing so `or <br />defer giving their opening statement to before they present their case -in -chief. "' This was <br />Amanda's recommendation. <br />MR. WISEMAN: That follows court procedure. <br />Page 22 <br />
