HONG: And did anybody, at that point, tell you that they were going to cancel the <br />recruitment that my client successfully was awarded? <br />MR. PAUSE: I don't recall the exact terminology but they made the statement that they needed <br />to make changes to the to that job description and send it back out for re -recruiting. <br />MR. HONG: After you sent that memo or the email to the HR Director, what, if anything, <br />happened? <br />MR. PAUSE: I know I had subsequent follow-up conversations with the HR Director and I, <br />again, plead my case to allow the well -performing employee to continue in this role. And the <br />only thing that I would note was that she told me that —or I told her that it was unfortunate —and <br />she told me that if, in fact, the employee had made it through his 6-month probation period, there <br />wouldn't be anything that they could have done to remove him from the job and enforce the re - <br />recruitment. <br />MR. HONG: Did you have any meetings with the Mayor regarding this particular appointment? <br />MR. PAUSE: I discussed this with the Mayor and plead with him to find out if there was <br />something he could do and his comment to me was, "No" —that —"ultimately, it had to come <br />before the Merit Board." <br />MR. HONG: And in terms of what happened —was, at the —well, let me rephrase that question. <br />Was he, subsequently —was my client, subsequently, demoted? <br />MR. PAUSE: He was placed back into the position he held before he had taken on this one. <br />Correct. <br />MR. HONG: And in terms of the process before he was sent back to his original position, in <br />your mind, was this still a recruitment or was he a probationary appointee? <br />MR. PAUSE: While he was performing his duties, the first 6-months in that position that began <br />on December I" of `23, he was a probationary employee. <br />MR. HONG: Thank you.
