Merit Appeals Board <br />November 26, 2024 <br />MS. MATHEWS: So moved. <br />MR. KUNZ: Second. <br />CHR. CABANAS: And so, we should vote on the withdrawal of the motion? No need to vote <br />okay, very good. <br />So, we will proceed with scheduling the hearing for Mr. Kaye. Our Secretary has checked on the <br />availability of the Council Chambers, which is January 16'', 2025. It's a Thursday, at 9 a.m., <br />here, in the Hilo Council Chambers of the Hawaii County Building, at 25 Aupuni Street, First <br />Floor, Room 1401, in Hilo. <br />MR. WISEMAN: Madam Chair? <br />CHR. CABANAS: Yes, Mr. Wiseman? <br />MR. WISEMAN: Yeah. I'm not sure —we can run it by Counsel —but I think we need a motion <br />to go forward in hearing this appeal based on "Exhibit 3," the decision from the Human (sic.) <br />Relation Board and there being no opposition. <br />CHR. CABANAS: Mr. Halvorson, do we need a motion to schedule the hearingI was just <br />reviewing the dates that our Secretary -Reporter provided? <br />MR. HALVORSON: It's cleaner, if you do it by motion. <br />CHR. CABANAS: We can do it by motion —okay. So, may I have a motion to schedule the <br />hearing? <br />MR. WISEMAN: Yes, I'll make a motion that in view of the "Exhibit 3," which is the <br />required toa ruling and order from the Department of Human Resources, saying that the Merit <br />Appeals Board does have jurisdiction, and there being no opposition from the other party— <br />CHR. CABANAS: Excuse me, Mr. Wiseman. The ruling is from the Hawaii Labor Relations <br />Board. <br />MR. WISEMAN: I stand corrected. <br />CHR. CABANAS: Yeah. <br />MR. WISEMAN: So, in view of that, I make a motion that we accept the appeal and schedule <br />the hearing dates. <br />CHR. CABANAS: Okay, very good. Is there a second? <br />Page 5 <br />
