Merit Appeals Board <br />April 22, 2025 <br />But with all the evidence I have, which I've compiled here over the last 10 months, I would like <br />to present that if you guys are going to have that meeting and it not be just the County's <br />evidence —like, it has been in the past. So, that would be my request. <br />CHR. CABANAS: Okay. Thank you, Mr. Kailiawa-Smith. The Chair acknowledges both the <br />County's concerns and Mr. Kailiawa-Smith's concerns. <br />So, what we're going to do is schedule another hearing and we're looking at the hearing date of <br />June 24 h. And the only reason why it's, kind of, stretched out that way is because we have other <br />hearings for our May meeting. So, next in line would be yours. <br />MR. KAILIAWA-SMITH: (Inaudible.) <br />CHR. CABANAS: Okay, is your mic. on? Yeah. <br />MR. KAILIAWA-SMITH: Yeah, whatever timeframe you guys have is fine with me. I mean, <br />it's been almost a year already that they've dragged this out, so what's a couple more months or <br />a month. <br />CHR. CABANAS: Okay. Any concerns, Mr. Lametti? <br />MR. LAMETTL Thank you, Chair. I believe I'm free on that day, so I'm more than happy to <br />that day works for the County and for me. <br />CHR. CABANAS: Okay. <br />MR. LAMETTL I guess, my question would be —is the Board's intention to hear I'd be happy <br />to file a motion to dismiss to be heard on that day, that could lay out the issues that I mentioned <br />before about jurisdiction or other groundsI think that may prevent or may be advisable for the <br />Board not to hear this case. <br />So, I guess my question would be, does the Board want to hear that first on June 24 h and then set <br />a further date for a hearing on the merits or <br />CHR. CABANAS: The answer is "yes." <br />MR. LAMETTL Okay. <br />CHR. CABANAS: Okay. So, our secretary has provided deadlines for me to read to both of <br />you. And I'm going to read it to you, so you can take your notes but then, we will also send <br />both of you a certified letter notifying you of the date, time, location, and the various deadlines <br />but you can take some notes now.
