A certified shoreline survey of the subject property was issued on August 13, 2024, by <br /> the Board of Land and Natural Resources. The applicants should recognize that the <br /> shoreline setback line, which may be more than minimum 40 feet inland from the <br /> certified shoreline on the subject site, shall be determined by the County Planning <br /> Department. <br /> Applicants' response: The Applicants believe that this final determination regarding the <br /> extent of the shoreline setback lies with the Windward Planning Commission, who will <br /> ultimately determine the outcome of the Applicants' SMA Use Permit application. <br /> 4. The applicant shall ensure no proposed structures and construction activities, including <br /> staging areas, will occur within the shoreline area as determined by the County Planning <br /> Department. OPSD recommends that the applicant be required to place and maintain <br /> stakes and flags at the location of the shoreline setback line during the construction, and <br /> these stakes and flags shall be clearly visible for the purpose of inspection and <br /> monitoring. <br /> Applicants' response: The Applicants have no objections to the OPSD recommendation <br /> that the Applicants be required to place and maintain stakes and flags at the location of <br /> the shoreline setback line during the construction, and these stakes and flags shall be <br /> clearly visible for the purpose of inspection and monitoring. In fact, such physical <br /> delineation of the shoreline setback area during construction was presented by the <br /> Applicants in their SMA Use Permit application. <br /> 5. All exterior lighting and lamp posts associated with the proposed residential development <br /> shall be cut-off luminaries to provide the necessary shielding to mitigate potential light <br /> pollution in the coastal areas, and lessen possible seabird strikes. No artificial light, <br /> except as provided in FIRS §205A-30.5(b), shall be directed to travel across the property <br /> boundaries toward the shoreline and ocean. <br /> Applicants' response: The Applicants have no objections to the OPSD recommendation <br /> that all exterior lighting and lamp posts associated with the proposed development shall <br /> be cut-off luminaries to provide the necessary shielding to mitigate potential light <br /> pollution in the coastal areas, and lessen possible seabird strikes. Furthermore, no <br /> artificial light,except as provided in HRS §205A-30.5(b), shall be directed to travel <br /> across the property boundaries toward the shoreline and ocean. <br /> Department of Health - memo dated July 21, 2025 <br /> The Applicants acknowledges the comments offered by the Department of Health regarding <br /> standards and requirements relating to dust control, water quality, mitigating excessive noise <br /> and the effects of hazardous substances, wastewater and solid waste. <br />
