I - L <br />Location ofproposedficensedpremises <br />KIND OF BUSINESS: Applicant plans to manufacture three (3) days a week, between the <br />hours of 10.-00 a.m. — 4:00 p.m. No manufacturing will be done on Saturdays and Sundays. <br />Applicant would like to manufacture small batches of rum, rye whiskey and vodka using locally <br />sourced ingredients, including sugar cane, ulu and bananas that are farmed by the Applicant. <br />Applicant will not have agricultural tourism at this location-9 i.e. on -site retail sales and/or <br />product tasting and will handle the distribution of their products directly to liquor licensees. For <br />further information, please refer to Exhibit 6 attached. <br />LEASE AGREEMENT: This Lease Agreement ("Lease") made on April 5, 2025, by and <br />between Charmaine Banther ("Landlord") and Hamakua Distillery LLC ("Tenant"), commenced <br />on May 1, 2025 and will end on April 30, 2028. The Landlord and Tenant shall be required to <br />negotiate renewal options or the Tenant will be forced to vacate the premises. <br />ALCOHOL AND TOBACCO TAX AND TRADE (TT ) PERMITS: Forthcoming. <br />ZONING: Agricultural. Per emails dated June 3, 2025 and March 31, 2025 from the Planning <br />Department, based upon the information that was provided to the Planning Department by the <br />Applicant, their proposed micro -distillery is classified as "Agricultural Products Processing, <br />Minor" under the zoning code. For further information, please refer to Exhibit 7 attached.,, <br />SURROUNDING AREA: Survey of the surrounding area reveals that there are no churches, <br />schools or liquor licenses with the same class and kind located within 500 feet of the proposed <br />licensed premises. <br />At the present time, there are two (2) of the same class of liquor license being lawfully exercised <br />in the County of Hawai'i. <br />
