"Special Management Area Use Permit" approved by the Planning Commission is <br /> required for the proposed development at 14 Oeoe St., under Nos.: <br /> (2) curtails the range of beneficial uses of the environment;u <br /> (3) conflicts with the long-term environmental policies or goals of the <br /> General Plan- 1 or the State Plan;u <br /> (4) significantly affects the economic or social welfare and activities of <br /> the community, County or State; [Fn. 1.] <br /> (10) is contrary to the objectives and policies of the Coastal Zone <br /> Management Program and the Special Management Area Guidelines <br /> of Chapter 205A, HRS.0 <br /> "Special Management Area Use Permit" means an action by the authority <br /> authorizing development ...which may have a substantial adverse environmental or <br /> ecological effect, taking into account potential cumulative effects." §205A-22 <br /> Definitions. "Special management area use permit" procedures under Planning <br /> Commission Rule 9-4(u) definitions and Rule 9-11 are required as a matter of law. <br /> I am an "Affected owner" whose property is "within three hundred feet of any <br /> point of the boundary of a lot where a Nonconforming Use Certificate is being <br /> sought." <br /> I have provided the advertisement and booking confirmation for 14 Oeoe St. , <br /> Attachment-3, that is prima facie evidence that the owner of 14 Oeoe St. is booking <br /> rentals for twelve unrelated individuals under the definition of"Family" and <br /> "single-family residence" that most likely will arrive in more cars than can park in <br /> four individually accessible parking spaces, and that the booking will likely cause <br /> on-street parking and egress issues injuring my interests.
