A. RECORD ON APPEAL
Pursuant to Board of Appeals Rules 3-13(h) and 1 3(21), the following documents are
directly related to the decision that is being appealed:
1. This Property Owner Declaration Form was submitted on December 17, 2024, along
with the application for building permit PW,B2024-0051123: the Declaration states
that ichard Standke and Deborah Standke (collectively “Standke") are the owners of
-FMK (3)-2-2018-013,
2, The drawings and plans submitted by Standke as part of their application for building
permit PW,B2024-005123 ("Project"), This document shows that on January 13,
2025, the Planning Department determined the Project to be exempt from any further
Special Management Alrea requirements.
3. This is Planning Department's Short Form Assessment/Exemption Determination for
Non-Shoreline Parcels for the Project, which shows that on January 13, 2025, the
Planning Department detei Mined the Project to be exempt from any further Special
Management Area requirements.
4. 'fhis is the lIroject Declaration for the Project, where Richard Standke certifies that
the Project is "Owner-Builder." This document was submitted to Public Works on
April 1, 2025.
5. A copy of building permit PW.B2024-1005123, which was issued to Standke on April
1, 2025.

STANDARD CONDITIONS OF APPROVAL AND ACKNOWLEDGEMENT
The items checked on Page 1 are hereby considered exempt from the definition of"Development" pursuant to
HRS §205A-22, subject to the following conditions to assure that the proposed use, activity, or operation does
not have a cumulative impact,or a significant adverse environmental or ecological effect on the SMA:
1. The applicant shall secure all necessary approvals and permits from other affected federal, state, and
county agencies as necessary to comply with all applicable laws and regulations.
2. This exemption only applies to the proposed uses activities and operations as presented on Page I, No
additional development shall be allowed within the SMA without obtaining a permit.
3. Artificial light from exterior lighting fixtures, including, but not limited to floodlights, uplights, or
spotlights used for decorative or aesthetic purposes is prohibited if the light directly illuminates, or is
directed to project across property boundaries toward the shoreline and ocean waters, except as may
otherwise be permitted pursuant to HRS §205A-71(b).
4. In the unlikely event that surface or subsurface historic resources, including human skeletal remains,
structural remains (e.g. rock walls, terraces, platforms, etc.), cultural deposits, marine shell
concentrations, sand deposits, or sink holes are identified during the demolition and/or construction work,
cease work in the immediate vicinity of the find, protect the find from additional disturbance and contact
the State Historic Preservation Division at(808)933-7651.
5. Best Management Practices regarding water quality and equipment maintenance must be strictly adhered
to during all phases of construction to ensure that no construction or equipment runoff enters a coastal or
riparian area.
