NOTICE OF PUBLIC HEARING <br />NOTICE IS HEREBY GIVEN of a public hearing to be held by the Police Commission, County of Hawaii, <br />in accordance with the provisions of Chapter 91 of the Hawaii Revised Statutes. <br />Date: April 23, 2010 <br />Time: 9:00 a.m. <br />Place: Old Mayor's Office Conference Room <br />75 -5706 Kuakini Hwy., Suite 103, Kailua -Kona <br />The purpose of the public hearing is to afford all persons the opportunity to submit data, views, or <br />arguments, orally or in writing, to the Police Commission for its consideration prior to the adoption of the <br />proposed amendments to its rules and regulations as summarized below. All written comments should be <br />filed with the Police Commission at 101 Pauahi Street, Suite 9, Hilo, HI 96720, by April 13, 2010. The <br />Police Commission may make a decision to adopt these amended rules during this public hearing or at its <br />monthly meeting immediately following the public hearing. <br />The following is a summary of the substantive changes proposed by the Police Commission: <br />• Addition of a mission statement. <br />• Addition to powers, duties, functions to be in line with the County Charter. <br />• Addition of description of duties and functions of standing committees. <br />• Deletion of contractual services committee. <br />• Extends the time limit for filing a complaint from 60 to 90 days from date of incident. <br />• Addition to allow the commission to accept a complaint for any reason it deems acceptable. <br />• Addition to classification of findings, adding referral to the chief for further investigation by <br />internal affairs or other appropriate division. <br />• Addition to classification of findings, adding referral to the chief for customer service, <br />procedural, operational, administrative, or jurisdictional concerns. <br />• Addition of a burden of proof statement when investigating and evaluating complaints. <br />• Addition of subpoena powers. <br />• Deletion of office of chief of police as a location for obtaining information. <br />• Addition to counsel for police officers, that the commission may assign a non - police <br />investigator. <br />• Addition to contested case procedures, that the presiding officer shall be designated by the <br />commission. <br />• Addition of a confidentiality statement for disclosure of information. <br />• Addition of a statement that the rules shall be posted on the internet at a website endorsed by <br />the County of Hawaii. <br />A copy of the proposed amended rules may be obtained at the office of the Police Commission, Aupuni <br />Center, 101 Pauahi St., Suite 9, Hilo, HI 96720; Monday through Friday, 7:45 a.m. to 4:30 p.m. Interested <br />persons may call (808) 932 -2950 for a mailed or e- mailed copy. <br />Tom Whittemore, Chair <br />Police Commission, County of Hawaii <br />Note: If you require an accommodation or auxiliary aid and /or service to participate in this meeting, please <br />call (808) 932 -2950 five business days prior to the meeting. <br />Hawai `i County is an Equal Opportunity Provider and Employer. <br />
