Police Commission Meeting Page 3 May 16, 2003 EXECUTIVE SESSION To consider discipline and charges against officers or employees of the Hawai'i County Police Department where consideration of matters affecting privacy will be involved and a closed session is requested and to consult with Corporation Counsel on questions and issues pertaining to the commission's powers, duties, privileges, immunities, and liabilities pursuant to HRS 92 -5 (2) and Hawai'i County Charter Section 13 -20 (b). • Correspondence 03 -40, request for legal counsel by Detective Lucille Melemai in CV No. 02 -1 -0368. • Status Report of Complaints Referred to the Police Chief. Status Report of Complaints Referred to the Investigator. Investigation of Complaints. Complaint HPC 02 -32: Complainant alleged that during his arrest following an argument with his girlfriend, an officer choked him, threw him onto the hot asphalt, and used profanity. Akal's investigation will be reviewed. Complaint HPC 01 -27: Complainant was arrested during a DUI stop. She alleged that an officer used excessive force during her arrest. Akal conducted an investigation, but the case was deferred at the last meeting in order for the commission to obtain additional information. Complaint HPC 02 -65: Complainant was arrested for violating a TRO. She alleged that the captain should not have ordered her arrest. The complaint was deferred at the last meeting after being notified that the complainant would be withdrawing her complaint. The commission will review complainant's letter of withdrawal. Complaint HPC 03 -05: Complainant alleged that when officers responded to her complaint about a careless motorist, an officer took the motorist's statement, but not hers. She also alleged that the officer laughed while listening to the motorist, and would not let her borrow his pen. Complaint: HPC 03 -06: Complainant alleged that an officer issued her a citation, and then told her brother, who is a police officer, about the citation. ACTION ON EXECUTIVE SESSION MATTERS STATEMENTS FROM THE PUBLIC ANNOUNCEMENTS The next monthly meeting is scheduled for June 20, 2003, at 10:00 a.m., at the Hilo Hawaiian Hotel. The Solutions 2003 Seminar will be held on Saturday, May 17, 2003, at the Waikoloa Beach Marriott and Outrigger Resort.
