1. Referral for Executive Session Regarding the Selection Process
for the New Director of the Department of Liquor Control
The Commission anticipates convening an executive meeting pursuant to
Sections 92-4 and 92-5(a)(4) of the Hawai'i Revised Statutes, as amended,
for the purpose of consulting with the Commission's attorney on questions and
issues pertaining to the Commission's powers, duties, privileges, immunities,
and liabilities, as it relates to determining the selection process for the new
Director of the Department of Liquor Control.
A 213 vote of the members present is necessary to hold an executive meeting,
pursuant to Section 92-4(a) of the Hawai'i Revised Statues, as amended.

years.
LOCATION OF PREMISES: The proposed licensed premises is located at the Honokohau
Harbor, Gentry's Kona Marina, 74-425 Kealakehe Parkway, Space No. 17, Kailua-Kona,
Hawaii. For further information, please refer to the site map of the premises, attached as
Exhibit 1.
This location had a previous Restaurant Beer and Wine liquor license under Keoni's Point of
View, LLC, dba Keoni's Point of View, who cancelled its liquor license on February 25, 2424.
DETAILS OF PREMISES: The premises is situated within a single -story wooden building and
contains approximately 1,128 square feet of interior space and approximately 1,189 square feet
of exterior space, for a total of 2,317 square feet. It will consist of a kitchen, office space, bar
with seating, dining area, and an outside lanai area with additional seating. For further
information, please refer to the floor plan of the proposed premises, attached as Exhibit 2.
Common shared separate men and women restrooms are located in the Kona Marina Gentry's
main building. Ample parking is available within the Kona Marina Gentry. For further

Applicant is currently working with Department of Public Works to obtain a Building Permit to
install a single, unisex, ADA restroom within its proposed licenses premises.

KIND OF BUSINESS: Applicant will operate as an Asian Sushi restaurant from 11:00 a.m. —
9:00 p.m., six (6) days a week, Tuesday through Sunday, closed on Mondays.
Employment will consist of approximately six (6) employees, three (3) of which will be certified
by the Department of Liquor Control to supervise the sale, service, and consumption of liquor.
HARBOR LEASE NO. H-82-4: This Harbor Lease No. H-82-4 ("Lease") was made on the Wh
day of April 1983, by and between the State of Hawaii, by its Director of Transportation,
("Lessor") and Gentry -Pacific, Ltd., ("Lessee"). The term of said Lease was for thirty-five (35)
years, having commenced on April 1, 1984, and having expired on March 31, 2019.
EXTENSION OF HARBOR LEASE NO. H-82-4: This Extension of Harbor Lease No.
H-82-4 ("Extension") was made and entered into on the 12 th day of May, 2006, by and between
the State of Hawaii, hereinafter referred to as the ("Lessor"), by its Board of Land and Natural
Resources, hereinafter referred to as the ("Board") and GKM, INC., a Hawaii corporation,
whose address is 74-425 Kealakehe Parkway, Kailua-Kona, Hawaii 96740, hereinafter referred
to as the ("Lessee").
Harbor Lease No. H-82-4 ("Lease") was extended for an additional twenty (20) years, from April
1, 2019, up to and including March 31, 2039. All terms, conditions, and covenants contained in
said Lease shall continue to remain in full force and effect until the termination date of the
Extension, unless sooner terminated
ASSIGNMENT OF LEASE: An Assignment of Lease was entered into on October 15, 2002,
by and between Gentry Properties ("Assignor") and GKM, Inc., ("Assignee"), where Assignor
sold, assigned, transferred, set over and delivered unto Assignee all of that certain Harbor Lease
No. H-82-4 dated April 8, 1983, made by and between the State of Hawaii as Lessor and
Gentry -Pacific, Ltd., as Lessee; consent thereto given by the State of Hawaii, Board of Land and
Natural Resources, by unrecorded instrument executed March 19, 2003.
ZONING: County -Open / Use not permitted per zoning unless DLNR approves. Applicant is
working with DLNR to obtain required approval letter.
SURROUNDING AREA: Survey of the surrounding area reveals there are no schools or
churches, or liquor licenses with the same class and kind located within 500 feet of the proposed
licensed premises.
At the present time, there are 136 of the same class and 119 of the same kind of liquor licenses
being lawfully exercised in the County of Hawai'i.

NATURE OF APPLICATION: This is an application for an original Cabaret liquor license.
CLASS 11, CABARET LICENSE: A cabaret license shall be general only and shall authorize
the sale of liquors for consumption on the premises. This license shall be issued only for
premises where food is served, facilities for dancing by the patrons are provided, and live or
amplified recorded music or professional entertainment, is provided.
Meals prepared in suitable kitchen facilities connected therewith, containing the necessary
equipment and supplies for cooking an assortment of foods, shall be available to patrons while

Landlord submitted a Consent and Acknowledgment for Liquor License Application dated June
12, 2025 consenting that Tasmine Curenton, named in the Lease as the Tenant for the referenced
address of 202 Kamehameha Avenue, Hilo, Hawaii, may proceed with applying for a liquor
license with the County of Hawaii, Department of Liquor Control. Landlord also acknowledged
and recognized that Tasmine Curenton is the authorized representative of Black Onyx
Entertainment LLC, operating under the dba Black Onyx and is applying for a liquor license.
ZONING: Downtown Hilo Commercial District / State Land Use — Urban.
SURROUNDING AREA: Survey of the surrounding area reveals that there is one church,
Central Christian Church, and one school, Connections Public Charter School, located within
500 feet of the proposed licensed premises.
There are no liquor licenses with the same class located within 500 feet of the proposed licensed
premises.
At the present time, there are two (2) of the same class of liquor license being lawfully exercised
in the County of Hawaii.
DETERMING PROTESTS WITHIN 500 FEET OF A SCHOOL OR PLAYGROUND:
Section 281-39.5 of the Hawaii Revised Statutes, as amended, states in relevant part, "The
liquor commission... may deny or restrict the issuance of a liquor license for on -site sale and
consumption by the drink to any applicant whose establishment is or would be located within
five hundred feet of a public or private elementary, intermediate, or high school, or public
playground utilized extensively by minors, as determined by the liquor commission."
Section 281-39.5 of the Hawaii Revised Statutes, as amended, also states in relevant part,
"...that the liquor commission... shall deny the issuance of a liquor license if forty per cent of the
registered voters... owners and lessees of record of real estate and owners of record of shares in a
cooperative apartment within five hundred feet of the nearest point of the premises for which the
licensed is asked; have duly filed or caused to be filed their protests against granting the license."
PREVIOUS OPERATION AS A NON -LICENSEE: On or about November 10, 2024, our
Department received a tip that a business located at 202 Kamehameha Avenue in Hilo was
selling and serving liquor, including offering bottle service, without a liquor license. Upon
further investigation by the Department, including an undercover investigation, it was
determined that Applicant was selling and serving alcohol without a liquor license.
On November 27, 2024, the Department of Liquor Control delivered/issued Applicant a notice to
immediately cease and desist all liquor operations, including but not limited to the sale (selling,
serving, or furnishing) of liquor, to surrender its liquor inventory and appear before the Liquor
Commission on January 9, 2025. Approximately, twenty-six (26) bottles of liquor were removed
from the premises.

Prior to the January 9, 2025, Liquor Commission meeting, the Department met with Applicant
on January 6, 2025, to discuss her situation. The Department told the Applicant that if she
wanted to continue selling and serving liquor, she should get the proper government approvals
and apply for a liquor license so she could be properly licensed in our County. At the
conclusion of the meeting, Applicant agreed to: NOT sell and serve liquor without a liquor
license; apply for a liquor license if she wanted to sell and serve liquor; the forfeiture of the
liquor from November 27, 2024. Therefore, the hearing regarding the Cease -and -Desist Letter
dated November 27, 2024, was removed from the January 9, 2025, Liquor Commission agenda.
As of meeting with Applicant on January 6, 2025, our Department has not received any
complaints or know first-hand of Applicant selling and serving liquor illegally at her premises.
SECTION 281-56(6), HRS: The applicant has complied with the minimum requirements set
forth under Chapter 281, Hawaii Revised Statutes, as amended, relative to the making and filing
of this application.

DETAILS OF PREMISES: The proposed licensed premises is located in a single -story,
wooden structure consisting of approximately 6,930 square feet. Within the structure there is a
certified kitchen and storage room, main dining room, meeting room, bar, and another larger
tatami room which Applicant plans to use for overflow and/or private parties. There is also an
enclosed uncovered lanai / designated smoking area attached to the bar side of the premises.

KIND OF BUSINESS: Applicant plans to operate under two (2) dbas, Itsuko's Kitchen for the
restaurant and dining area, and Banzai 47 for the bar.
Itsuko's Kitchen will be open seven (7) days a week from 5:00 a.m. — 1:00 p.m., serving
breakfast and brunch items, and reopen from 6:00 p.m.- 1:00 a.m., the following day, serving
appetizers, burgers, and noodles.
Banzai 47, the bar, will be open seven (7) days a week from 2:00 p.m.- 2:00 a.m., the following
day. Banzai 47 will operate as an adult bar for 21 years and over only, with pupus available
during its hours of operation.
For further information, refer to the floor plan attached as Exhibit 4.
Employment will consist of approximately ten (10) employees, four (4) of which will be certified
by the Department of Liquor Control to supervise the sale, service and consumption of liquor.
Applicant would like to have live entertainment in the form of karaoke, a DJ, and/or a band
while open for business. Applicant currently has no set schedule for live entertainment; however,
they are considering Thursday — Saturday evenings.
Applicant has been operating its food truck, Itsuko's Kitchen, since 2022 and has participated in
multiple pop-up night markets and events since then.
GENERAL LEASE NO. S-5001: Forthcoming. Applicant is currently working with DLNR on
the Request for Consent to Assignment of General Lease S-5001.
ASSIGNMENT OF GENERAL LEASE NO. S-5001: This Assignment of General Lease No.
S-5001, dated September 8, 2025, by and between Pubtime, Inc, ("Assignor") and Itsuko's, LLC,
("Assignee"), does hereby assign, transfer and set over unto the Assignee as tenant in severalty:

County parks, referred to as the Kuawa Street Sports Fields, and Walter Victor Baseball
Complex, that is used by the youth for various athletic events, located within 500 feet of the
proposed licensed premises.
At the present time there are 138 of the same class and 120 of the same kind of liquor licenses
being lawfully exercised in the County of Hawaii.

My name is Michael Mejia, manager of MamaMaria LLC, dba Gill's Lanai. I am writing to
respectfully request an additional twelve-month extension on our liquor license application
process.
Since our last extension, we have been actively working with our landlord, engineers,
architects, and the County of Hawai0i Planning Department to satisfy all compliance
requirements and obtain approval of our Change of Use permit. All required documents have
been completed and submitted, and we are now awaiting final review and response from the
Planning Department.
While significant progress has been made toward full compliance, final approvals and
subsequent inspections remain pending due to procedural review timelines that are beyond
our control. Granting this one-year extension will allow us to complete the process diligently
and ensure that all steps are performed in accordance with County and Commission
standards without risking a lapse in our application status.
We remain committed to operating responsibly within our community and to maintaining the
high standards expected by the Liquor Commission. Thank you for your continued
understanding, support, and consideration of this request.
