Fuke: It's been moved and seconded that the licensee be found in violation of the charge, any <br />discussion? <br />There was no discussion by Board Members. <br />Fuke: If not, all those in favor please say "Aye." <br />The Board Members voted "Aye." <br />Fuke: Opposed, "Nay." <br />There was no opposition by Board Members. <br />Fuke: Motion is unanimously carried. <br />The motion was carried unanimously <br />Fuke: Ms. Frenz, could you read the Department's proposed recommendation for penalty? <br />Frenz: Yes, it's a $1,000.00 fine, with $500.00 suspended for the next one (1) year on the <br />condition that this licensee commits no similar law violations. The $500.00 is to be paid to the <br />Department within 30 days of receipt of the Decision and Order for this violation. I would also <br />indicate just for the Board 's information, this licensee has no prior violations. They also have <br />taken responsibility and similar violations by other licensees result in the same <br />recommendation by the Department. <br />Fuke: Thank you very much. Board Members, you've heard the Department's proposed <br />recommendation of $1,000.00 with $500.00 being suspended, any discussion on the penalty? <br />Davenport: Brandon, what's the maximum? Was that the maximum, $1,000.00? <br />Gonzalez: No, the maximum for violations per statute is up to $5,000.00 per violation. <br />Davenport: Up to $5,000.00. <br />Gonzalez: What the Prosecutor explained was our past cases before the Adjudication Board, <br />we have imposed $1,000.00 fines, the highest per offense. <br />Hughes: But actually it's a $500.00 fine if there is no more infractions? <br />Gonzalez: Yes, the suspension takes into account the circumstances and their history.
