I. Call to Order
The meeting was called to order by Chair Yadao at 10:00 A.M., in the Hilo Meeting
Room, Department of Liquor Control, Hilo Lagoon Centre, 101 Au pu n i Street, Unit 230, Hilo,
Hawaii.
The following were present and constituted a quorum:

stay in a job that is comfortable but change brings opportunity for new experiences and

Yadao: If you can state your name and relationship to the business?
Tokunaga: Hi everyone, my name is Mykala Tokunaga, and I'm here as an applicant
for The Bunker Hilo, which is a new stand-alone project under my family business
S. Tokunaga Store. The Bunker Hilo is a golf simulator and retail space that is not
yet open. The intent is to create a controlled indoor recreational environment where
people can enjoy golf simulators and purchase golf related merchandise. And, with the
Commission's approval, responsibly enjoy alcoholic beverages as a secondary amenity.
This is not a bar or nightlife concept, the focus is on recreational skill -based activity
and a relaxed social setting. Because it's contained indoors, we're able to manage
operations carefully and ensure minimal impact to the surrounding area. We believe
this project will offer something new and fun to Hilo. Thank you again for your time
and consideration, and I'm happy to answer any questions you may have.
Yadao: Thank you for describing your business. Have you received the application
report?
Tokunaga: Yes.
Yadao: Are there any changes to the report?
Tokunaga: We did get the final plan approval.
Yadao: Director, are there any reports of protests?
Waltjen: Chair, the applicant mailed 13 out of 13 notices within 100 feet, 122 out of 122
within 500 feet, and one notice to a condominium or cooperative apartment manager.
There were 116 properties within 500 feet entitled to protest, we received no protests
to this application.
Yadao: Is there any public testimony at this time?
Benevides: Aloha everyone, my name is Ray Benevides and I am an owner of the
property on 89B Hoku Street. And the concern that we have in regards to a liquor
license there is how that will impact traffic on Hoku Street. We do have a homeless

concern on Hoku Street as well, and how is having an area where alcohol is being
served going to play a part to better the neighborhood, or create more challenges for us.
Waltjen: So, they're applying for a retail liquor license which means that everything
is sold for off -premise consumption. I do know that were are some maybe homeless
people occupying the house behind where they're at, and the applicant and their family
was looking to
Tokunaga: Yes, we did purchase the property right behind and we cleared it out.
Benevides: Yes, okay.
Tokunaga: That person isn't there anymore, I think there were multiple people living in
that tent.
Waltjen: I'm not sure if that was the only area that maybe you might have seen some
homeless.
Benevides: There's an area right in front of our property, we have a county access
road to take us into the flag lots that we have in the back, there is a community there
as well. So you know, there was just concern of a lot of high activity happening on
Hoku Street and how that may impact having business there that is selling alcohol.
Tokunaga: Yes, so there's only going to be like 2 simulator bays in the space and
we're going to only allow like 5 people per bay, and it will be basically appointment -
based time slots. I mean if there's walk in too and if there's availability then yeah,
we can service them.
Benevides: So, is it already in the existing building that is there?
Tokunaga: Yes.
Benevides: Or are you building it into the lot that's next to it?
Tokunaga: No, no, existing building, yeah.
Benevides: Okay, and then what is happening to the lot next to it?
Tokunaga: The lot next to it, like right next to the building, we don't own that small
piece of lot, but we just acquired the lot behind that had the homeless lady on it, yeah.
Benevides: And is there any plans for further development with that?
Tokunaga: No, not yet, yeah.
Benevides: Not yet, okay.

Nishimoto: Commissioner Nishimoto, if I may chime in. I am thinking that you now,
the clientele that golfs is probably a good clientele, and sometimes activity in the area
wards off unwanted type of you know homeless or whichever because there's you
know, people coming in and out, which kind of is good for the visibility of you know
the area. And people will be vigilant in kind of seeing it and taking care, so I'm thinking
that that's a positive to the area.
Benevides: Okay, and what about traffic on Hoku Street, it's a very narrow street
already, is there a study done on impact on traffic for that particular street because
people will be coming from Kino`ole to Kilauea?
Gonzalez: Brandon Gonzalez, Administrative Officer, when it comes to traffic, or
parking and those types of impacts, that's where the Planning Department review takes
into consideration, and I think we just heard the update is that Planning approval was
met. So, that satisfies that requirement and it's because they're moving into an existing
structure already that was there and not doing anything new, that was part of the factors
considered I think with the plan review, but that's a good question. And then from the
Department's perspective, Commissioner Nishimoto made a good point, our hope is
that with more use in the area, there is a mobile population in there from 7-Eleven all
the way down to Kilauea, and part of it is because there's nothing going on when it gets
dark. So, if there's more activity it may become less attractive for those people to loiter
there, but we gotta let it play out, so that might be the balance yeah, but very good
question.
Benevides: Okay, thank you very much.
Gonzalez: Thank you.
DeMattos: Aloha, I'm Mike DeMattos and we own the property 89A Hoku Street, and
just wanted to concur with the Commission that, that is the hope that a business like
this actually improves the community. We had some concerns about traffic and we
had some concerns about how the mobile homeless population there might negatively
impact the business. But the hope was always that the business would actually create
a different environment in that community that would attract people to that community,
keep the area busy while allowing the neighborhood to function the way it has. And so
think the concerns that my brother-in-law raised are really important, but that's the hope.
And Tokunaga's, they were there originally and then moved to the new store, for those
of us who obviously grown up around it, so we have great faith that that space can be
utilized in a way that improves that community, but we just want to make sure that
everyone is aware that that's a community that's facing challenges, and that those
challenges are not only in Hilo but throughout the Hawaiian Islands are feeling
insurmountable at times. And the hope is that in everything that we do, whether Liquor
Commission or other commissions that one eye is always on how to make sure that
that community thrives even while it moves forward and with businesses or residential
endeavors. So, my family is in support but we want to make sure that eye is always
there too, we never want a situation where the community's worldview is missed in the
conversation but we're excited to have a good business there.

Okabe: Do you have a community association in that area, neighborhood watch, and
things like that?
DeMattos: There is not one that I'm aware of, no.
Okabe: An area for the community to get involved with what your concerns are?
DeMattos: I think there's two things that would be really positive there, one is a
neighborhood watch and then the other is a community association.
Okabe: Yes.
DeMattos: There's a lot of long-standing families who live there, and some of them,
their keiki and mo`opuna are now living in those homes. So, the hope would be and
we've seen some of that, we've seen some home improvements in that neighborhood
even as we've seen homelessness move in. So it's been this two kind of parallel waves,
on the one hand you're seeing the residential area show marked improvements, and in
other areas particularly on Hoku Street where there are some vacant lots where we've
seen homelessness move in, and I think that's a concern for those of us who have kids
in the neighborhood.
Okabe: And it's also a renters area too, right? A lot of homes are rented.
DeMattos: There's two groups there, one is a high -rent group, and the other is the
ancestors of those who originally owned the homes and now those homes have now
been passed on.
Okabe: So, I would suggest that you know, the community you know send out flyers
and try to have a community association, and look at an opportunity for the community
to get involved in monitoring the concerns that you have.
DeMattos: Is there is there a county office that can help facilitate that?
Greenwell: Yeah, Police Department.
DeMattos: Police for neighborhood watch, right? But for community associations, are
there county offices that may help facilitate that process? Because, the neighborhood
watch is an important piece and that offers policing and surveillance, but you also don't
want policing in lieu of support. So, establishing a community association is the other
side of that coin, right? Is the support for the community and the neighborhood watch
is part of the policing and surveillance of that neighborhood. I think when you have one
without the other, it introduces a different climate to the neighborhood and you'd want to
make sure that both of those are met.
Nishimoto: I wonder if there's another community available similar to what you have
that have community support or community you know program that you might be able to
inquire with to see what they did.

Gonzalez: Another thing, the traffic concerns, that whole neighborhood is in transition,
yeah it has been for years. Another thought is I know the Council Member for the
district has helped address some of the traffic or parking concerns in Hoku Lane and
the other narrow lane more by Kawamoto's. So, check -in with your Council district
member, since they've helped the neighborhood before, that might be an avenue and
a resource.
DeMattos: Yeah, okay.
Benevides: Those were the concerns we had.
DeMattos: Yes, and mahalo to the Commission for hearing that, and mahalo to the
Tokunaga's.

Dinger: Good morning, my name is Matthew Dinger, and I am one of the owners of
Kona Biscuit Co. setting up at the QueensMarketplace in the former Sansei's location.
We are offering a from -scratch kitchen seven days a week, we offer breakfast and
brunch from 6:00 a.m. to 2:00 p.m., with a turnover service where we turn into The
Roost, which is a Hawaiian steakhouse from 5:00 p.m. to 9:00 p.m. on Thursday,
Friday, and Saturday evenings, where we hope to offer a higher -end dinner service.
Our goal is to offer as much local food, as much local produce and items to be

introduced to our food as possible, focusing much higher on quality versus quantity,
and our service is to offer that food at a lower cost than everybody around us simply
because it's a resort area, does not mean you have to charge resort cost, because we
hope to aside from tourists we very much hope to engage the locals. We'd love the local
business and offer a consistent product with a rotating menu, especially for the dinner
so they can be excited about what we have to offer and not get bored with our options.
We would like to have our liquor license because we also have a full bar like the former
Sansei's did as well. And I'm happy to answer any questions about menu, hours,
anything that you may have.

Ventura: So, it seems like the principles have you know various backgrounds, is this
the group's first venture into the restaurant business?
Dinger: Mine, yes. My business partner now, she's been in the restaurant business
for over 30 years, she's built many for others, she's designed, coordinated, staffed,
budgeted, managed, that be Melanie Fraser Davis, and her husband Bill has also done
all the building for multiple restaurant chains and such. I have mostly the restaurant
work, Melanie brings the expertise.
Ventura: And is the improvements from the prior tenant pretty much intact?
Dinger: They are intact.
Ventura: Thanks.
Dinger: There was a complete facelift.

Nishimoto: So, previously at the last hearing we talked about having biscuits and so is
this a new evening menu that you put together or was it always there?
Dinger: It was always there.
Nishimoto: The Hawaiian steakhouse menu that you have, is that for only the evening
time?
Dinger: That will be for the evening time, correct yes.
Nishimoto: And what time does that start?
Dinger: That will begin at 5:00 p.m.
Nishimoto: Okay, thank you.
Dinger: But did you have a question about the biscuit portion of it, like the breakfast
menu?
Nishimoto: Well, because at the beginning I was like, I remember having that question
about what kind of food was being served, and I said your name is biscuit so it has
biscuits in it, so it stuck out in my mind.
Dinger: Yes, the daytime is very biscuit centric, which they will be available at night as
well.
Nishimoto: The biscuit was brought to my mind, now I hear the steak, and I was like
oh okay.
Dinger: Steak and biscuits go very well together.
Nishimoto: Thank you for that clarification.

liquor license which is going to have four full-time employees and three have liquor
cards will be there the whole time are certified. And we have 1,300 square feet in our
whole location, and we have outside patio and including the inside space with the sushi
bar. So we serve Japanese sushi and izakaya, most of like nigiris, sashimi, and some
appetizers, and sake and beer.

Nishimoto: Commissioner Nishimoto, what is the seating capacity inside?
Wang: That would be like 50 people inside.
Nishimoto: Parking is very tight there.
Wang: We have front parking and back parking too, normally people don't know we
have back parking, yeah so we have lots of parking.
Nishimoto: Yeah, oh that's good.
Wang: And normally like in our Plaza the only restaurant is our restaurant, so they
have daytime restaurant, they're going to close at 3:00 p.m. So the rest of the time is
all our parking spaces.
Nishimoto: Thank you.

Greenwell: This is Greenwell, what is the origin of Toprich? Is that a chain, the name
Toprich, Inc.?
Wang: When I created the name, there's so much similar names like when you want
to create a company in the states. So, I did want to create a name like when I build any
kind of business under like dba (doing business as) they'll accept that. I don't want to
create a name like saying oh this is Sushi, Inc., so Miyazaki going to be this company
dba (doing business as).
Greenwell: So, is this the only restaurant under Toprich?
Wang: Yes, that's right this is the only restaurant.

Ocean Tower. We have no changes to the investigators report, this is for a restaurant
liquor license for a restaurant space located in the Ocean Tower. If you're familiar with
the property, the Ocean Tower is the one looks like 3 connected circles, it's on the most
northern side of the Hilton Waikoloa Village, and it's that bar area right where the tram
kind of stops and turns around. We're currently not operating at all in that space, we're

very excited to get this open. We want to bring more life and get a better guest

Ueoka: It is operating timeshare right now, looking at I think it's 480 units, 6-floor
building, but it's all same parent company, Hilton Resort Corporation owns entire
property and the entire resort.

Okabe: I'd just like to ask a question with Corp (Corporation) Counsel, if somebody
made a motion to say that you know, we make a motion to approve everyone and say
the name, motion to approve IVIS Honoka`a, LLC (Limited Liability Company), also No.
97 IVIS Kilauea, lump it in all one, and we can make one motion and done, right? Or we
have to do it individually?
Wan: It is better form to do it individually just in case for some reason if somebody
wants to vote no on one of the companies but approve all the others.
Okabe: I see, but then if you do it that way, somebody could say no and revert for that
reason, when we have the discussion, they will be able to state in the discussion as to
which one they wanted to eliminate, so they could say in parliamentary procedure that
you're going to or can we leave this one out, you know what I mean?
Wan: You can in discussion but then the motion would have to otherwise pass or fail.
Okabe: It could be amended?
Wan: Or it could be amended depending on I will say just because, how do I say this?
All of the different companies have rights, right? And if for some reason you were to go
against one of the companies like say voting not in favor of one of the companies, they
have a right. One of the things they might attack is the procedure and part of the fact
that you decided to just choose all of them together, you didn't give each one their right
due consideration. So, I'm not saying you're wrong, I'm just saying there's alternate
reasons for doing it the way you're doing it.
Okabe: Okay so it's not wrong, it's just that you could do it that way in parliamentary
procedure?
Wan: You could but at the same time if there's issues, it could cause an issue.
Sometimes the shortcut makes it more long in the long run.
Greenwell: So going forward for clarification, anybody that has a franchise would have
to be done separately, but if it's a chain ownership with the same directors, it could be
done either way?
Wan: So in this instance, there are different companies for each different establishment
in this one, so they each have a different license, right? That's why you've got a change
in manager for every single different branch.
Greenwell: Yeah, I understand what you're saying.
Wan: Okay.

Greenwell: And I don't mean to belittle this but it would seem to me that if it was a
franchise then you would have to do it that way and only that way, or this way and only
this way. But we have the option if it's a chain and all the directors are the same being
changed for all the stores?
Wan: So in this instance, it would be something where I just want to say from like a due
process standpoint, if you have the consent of the owner to do the motion one time for
all of them one time, I would say no problem, because you've asked, you've gotten
consent, you've done it, you know what I mean? But because the owner is not present
today, the person who's actually making the request is not present today, you can't say,
"Are you okay with us considering your applications 1 through 10 together?
Greenwell: Okay.
Wan: So, food for thought.
Greenwell: Okay, so with ownership permission it would be okay?
Wan: It would be better, yes. You would have less issues if the owner was present and
said yes, please consider all my applications at the same time.
