March 15, 2002 <br />Minutes — Regular Session <br />Page 3 <br />ACTION ON EXECUTIVE SESSION MATTERS <br />Request for legal counsel by Officer John Weber in Civil CV 02 00069 <br />Commissioner Lambeth moved that the officer acted within the course and scope of his duties. <br />Commissioner Muller seconded the motion, and it carried unanimously. <br />Complaint HPC 02 -01: Complainant alleged that while responding to a call from a local bar, the <br />officers would not listen to his story, threw him against his car, told him to leave, and would not <br />give him their names. <br />Commissioner Lambeth moved to decline further investigation because there was no misconduct <br />on the part of the officer. Vice Chair Hara seconded the motion, and it carried unanimously. <br />Complaint HPC 02 -03: Complainant alleged that while responding to a call of two guys ripping <br />off a house, an officer pointed a gun at his son and friend who were parked in front of his house. <br />Vice Chair Hara moved to decline further investigation because there was no misconduct on the <br />part of the accused officer. Commissioner Muller seconded the motion. <br />Discussion: Commissioner Lambeth asked that this complaint be referred to the Chief so that the <br />officer could be reminded to act professional by not making any side comments. <br />The motion carried unanimously. <br />Complaint HPC 02 -04: Complainant alleged that an officer spoke to her in a condescending and <br />sarcastic tone, hung up on her, was untruthful, slandered her, and yelled at her. She also alleged <br />that another officer was not truthful. <br />Commissioner Manago moved to decline further investigation because the complaints are <br />unfounded. Commissioner Muller seconded the motion, Commissioner Kama abstained, and the <br />motion carried. <br />Complaint HPC 02 -05: Complainant alleged that when she called 911 for assistance, a <br />dispatcher refused to send help. <br />Commissioner Manago moved to accept the complaint for further investigation. Commissioner <br />Moe seconded the motion. <br />Discussion: Vice Chair Hara stated that he thought they would consider deferring the complaint to <br />the next meeting in order for them to get a statement from the officer and /or dispatcher. <br />Commissioner Bertsch stated that a statement would come out in the investigation. <br />Commissioners Bertsch, Lambeth, Moe, Manago, and Kama cast aye votes. Commissioner Muller <br />and Hara cast nay votes. The motion carried. <br />Complaint HPC 02 -08: Complainant alleged that an officer cited him for parking on the curb. <br />The law does not prohibit parking on the curb. <br />
