Hawaii County Police Commission <br />Regular Session Minutes <br />August 20, 2002 <br />Page 8 <br />Complaint HPC 02 -27: Complainant alleged that an officer sneaked up her stairs without <br />calling out " "hello ". Commissioner Lambeth moved to exonerate the officer. The motion <br />was seconded by Commissioner Manago and unanimously carried. <br />Complaint HPC 02 -29: Complainant alleged that while citing a vehicle on the Kawaihae <br />Road, an officer made the driver stop in a position that created a traffic hazard. <br />Complainant also received a citation, and she alleged that the officer cited her for <br />speeding in a 35 mph zone when she was actually in a 45 mph zone. Commissioner <br />Muller moved to exonerate the officer. The motion was seconded by Commissioner <br />Manago and unanimously carried. <br />Complaint HPC 02 -32: Complainant alleged that while being arrested, an officer choked <br />him, and he fell unconscious. When he woke up the officer's knee was on his head. The <br />officer threatened to throw him down if he looked at anything. When he turned his head, <br />the officer grabbed him and slammed him on the ground. The officer also used swear <br />words and was hostile. Commissioner Lambeth moved to refer the complaint to the <br />investigator. The motion was seconded by Commissioner Moe and unanimously carried. <br />Complaint HPC 02 -33: Complainant stated that while being arrested, he resisted by <br />keeping his arms apart so as not to be handcuffed. He alleged that he was sprayed with <br />pepper spray and forced to the ground by five officers, and an officer choked him and <br />wouldn't stop until his wife told him to stop. Commissioner Lambeth moved to exonerate <br />the officer. The motion was seconded by Commissioner Manago and unanimously <br />carried. <br />Complaint HPC 01 -42: Akal Investigations investigated the complaint. Complainant <br />alleged that while he was with a friend in downtown Hilo at about 2:30 a.m., an officer <br />used profanity and threatened to beat him up. Commissioner Lambeth moved to not <br />sustain the charges of Standard of Conduct and Performance of Duty.
