INTRODUCTION AND SUMMARY <br /> The Appellant, Claudia Rohr, respectfully moves for reconsideration of the Chair's <br /> summary denial of the Amended Petition. This motion is based on factual error resulting in an <br /> arbitrary exercise of authority. Appellant's amended pleading was filed ten (10) days before the <br /> scheduled hearing fully satisfying the seven-day requirement of Board Rule 24(f). Despite <br /> this compliance, the Chair denied the amendment by citing non-existent"scheduled filing <br /> deadlines" and acting before the Appellees even responded. While Rule 3-1(b) grants the Chair <br /> power to manage proceedings, this general authority cannot be used to arbitrarily strip a party of <br /> a specific right granted by Rule 24(f). <br /> 1 <br />
