HAWAI'I COUNTY POLICE COMMISSION <br />MINUTES — REGULAR SESSION <br />FEBRUARY 21, 2003 <br />OHANA KEAUHOU BEACH RESORT <br />CALL TO ORDER <br />Chair Horace Hara called the meeting to order at 10:06 a.m. <br />ROLL CALL <br />Present: Horace S. Hara, Chair <br />Dwight K. Manago, Vice Chair <br />John M. Bertsch, Member <br />Paul M. de Silva, Member <br />Phoebe M. Lambeth, Member <br />Betsy Mitchell, Member <br />Peter P. Muller, Member <br />A quorum was present. <br />Also present: Lincoln S. Ashida, Corporation <br />Josie Pelayo, Secretary <br />Lawrence K. Mahuna, Chief <br />Thomas Hickcox, Assistant Chief <br />Absent: Walter Moe, Member <br />APPROVAL OF AGENDA <br />Commissioner Lambeth moved to approve the minutes with the addition of Correspondence 03- <br />09, copy of a letter from Peter Hendricks to Mayor Kim, announcing his resignation from the <br />police commission effective February 18, 2003. The motion was seconded by Vice Chair Manago <br />and unanimously carried. <br />STATEMENTS ON AGENDA ITEMS - Open to the public <br />Corporation Counsel Ashida stated that statements could be made either in open or closed <br />session. However, the commission may discuss the complaint against the police officer in <br />executive session <br />TOM SEIBLER, Complaint HPC 03 -02: Mr. Seibler stated that he called the police to report two <br />people stripping a car parked across the street from his home. He told the investigating officer <br />that the car had been there for about three months, and that there had been a lot of drug <br />dealings on the street. When the officer asked for his name, he asked, "Does it matter ?" The <br />officer responded in an arrogant manner. As the officer left, he yelled to him, "Did you vote? <br />Next time, don't vote for a criminal." Within two minutes the officer made a U -turn and came <br />back. He was afraid of the officer, so he went into his house and did not come out. The officer <br />told his neighbor to tell, "Mr. Doesn't Know" to stay within the law. This really scared him, so he <br />called the captain who told him to file a complaint. <br />STATEMENTS ON AGENDA ITEMS (executive session): None. <br />APPROVAL OF MINUTES <br />Commissioner Muller moved to approve the executive session minutes of November 8 and 29, <br />and December 9, 13, and 20, 2002; and regular and executive session minutes of January 17, <br />2003. The motion was seconded by Commissioner Bertsch and unanimously carried. <br />
