Therefore, the Department is issuing you a Notice of Violation <br /> and Order, with an administrative fine in the sum of ten thousand ($10,000) for the development of <br /> property (grubbing/grading a road and land clearing) without a Special Management Area <br /> Assessment (SMAA) permit. The violation must be corrected as stated in the Order below on or <br /> before the stated deadline date to avoid the accrual of daily fines. <br /> ORDER <br /> You are hereby ordered to take the following corrective action(s) at your own expense: <br /> 1. Immediately cease and desist any further unpermitted development, including cutting of <br /> trees/foliage on the subject property. <br /> 2. Apply for and secure an after-the-fact Special Management Area Use Permit Assessment for the <br /> unpermitted development (grubbing/grading) on your property. (Application must be submitted <br /> electronically) <br /> 3. Correct all violations at your own expense on or before the date specified below. <br /> 4. Pay all fines due this office and complete corrective actions by the deadline date of January 6, <br /> 2022. Payment may be made by cash, cashier's check, or money order. Personal checks are <br /> not accepted. Make cashier's check or money order payable to the County Director of Finance. <br /> 5. Immediately contact the Inspector listed below upon completion of your SMA application. <br /> Upon satisfactory compliance with all conditions of the above order, we may close the complaint <br /> with no further action. <br /> GENERAL INFORMATION <br /> 9-17 Penalties <br /> (a) Any person who violates any provision or this rule shall be liable for (1) a civil fine not to exceed <br /> $100,000; or (2) for the cost of returning the affected environment or ecology within the Special <br /> Management Area to the condition existing before the violation. <br /> 3 <br />
