Hawaii County Police Commission <br />Regular Session Minutes <br />May 21, 2004 <br />Page 8 <br />NEW BUSINESS <br />• CORRESPONDENCE 04 -10, CORPORATION COUNSEL ASHIDA'S COMMENTS ON THE <br />COMMISSION'S RECOMMENDATIONS FOR IMPROVEMENT TO THE DISCIPLINARY <br />SYSTEM OF THE HAWAII COUNTY POLICE DEPARTMENT. Commissioner de Silva <br />stated that they could not do anything about this until the issue with the labor <br />relations board is done. He suggested that they defer the matter. Commissioner <br />Lassiter motioned that they defer this indefinitely. Vice Chair Manago seconded the <br />motion. Discussion: Corporation Counsel Ashida suggested that they continue to carry <br />it on the agenda next month and in succeeding months so that they don't lose track of <br />it. The motion carried unanimously. <br />CORRESPONDENCE 04 -11, FROM CORPORATION COUNSEL ASHIDA REGARDING A <br />PROHIBITED PRACTICE COMPLAINT FILED BY SHOPO. Corporation Counsel asked to <br />speak to the commission in executive session in order for him to relay what he learned <br />from the Honolulu Police Department and because it may affect the commission's <br />potential exposure. <br />CORRESPONDENCE 04 -12, FROM COMMISSIONER DE SILVA REQUESTING AN <br />INQUIRY INTO THE ALLEGED ATTENDANCE OF TWO HAWAII COUNTY POLICE <br />COMMISSIONERS IN A PROCEEDINGS OF THE ADMINISTRATIVE REVIEW BOARD. <br />Chair Hara reported that they received responses from two commissioners and the <br />chief. <br />EXECUTIVE SESSION <br />Vice Chair Manago motioned to meet in executive session to consider discipline and <br />charges against officers or employees of the Hawaii County Police Department where <br />consideration of matters affecting privacy will be involved and a closed session is <br />requested and to consult with Corporation Counsel on questions and issues pertaining to <br />the commission's powers, duties, privileges, immunities, and liabilities pursuant to HRS 92- <br />5(2) and Hawaii County Charter Section 13 -20 (b). Commissioner Lassiter seconded the <br />motion, and it carried unanimously. <br />DISCUSSION ON POLICE COMMISSIONERS ATTENDING ARB HEARINGS <br />INVESTIGATION AND DELIBERATION OF COMPLAINTS <br />The commission convened into convened into executive session at 2:40 p.m. and <br />reconvened into regular session at 4:04 p.m. <br />ACTION ON EXECUTIVE SESSION MATTERS <br />• DISCUSSION ON POLICE COMMISSIONERS ATTENDING ARB HEARINGS. <br />Commissioner de Silva motioned to defer this matter because he has many questions, <br />and doesn't think they will be able to complete the inquiry until after the labor relations <br />
