Hawaii County Police Commission <br />Regular Session Minutes <br />October 15, 2004 <br />Page 5 <br />complaint. Hopefully, in the next few months, they won't be seeing anymore 90 -day <br />cases. <br />Other departmental activities: Deputy Chief Kubojiri stated that through Civil <br />Defense, they recently acquired a communications van. Communication is one of their <br />biggest problems. The vehicle has the capability to allow their people to talk to each <br />other. It has a cell phone, satellite site, three laptop computers, and a camera that <br />goes up 40 ft. <br />UNFINISHED BUSINESS <br />Correspondence 04 -49, from Lisa J. Sims - Hulsey requesting that the commission reopen <br />her complaint. Vice Chair Manago stated that this was deferred to that Kona meeting in <br />order for Ms. Sims - Hulsey to attend. However, she did not show up. He motioned to file <br />the correspondence. Commissioner Bertsch seconded the motion, and it carried <br />unanimously. <br />NEW BUSINESS <br />Review of chief of police evaluation form for chief's evaluation in December: <br />Chair Hara stated that normally they do a mid -year update in July, but he was not at that <br />meeting, and it was not done. When they do the evaluation in December, they will draw up <br />a matrix with ratings and comments and then generalize the comments. Chief Mahuna <br />stated that they are finalizing their goals and objectives. <br />EXECUTIVE SESSION <br />Vice Chair Manago motioned to meet in executive session to consider discipline and <br />charges against officers or employees of the Hawai'i County Police Department where <br />consideration of matters affecting privacy will be involved and a closed session is <br />requested and to consult with Corporation Counsel on questions and issues pertaining to <br />the commission's powers, duties, privileges, immunities, and liabilities pursuant to HRS 92- <br />5 (2) and Hawai'i County Charter Section 13 -20 (b). Commissioner Lassiter seconded the <br />motion, and it carried unanimously. The commission convened into executive session at <br />11:37 a.m., and reconvened back into regular session at 11:48 a.m. <br />ACTION ON EXECUTIVE SESSION MATTERS <br />Investigation and Deliberation of Complaints: <br />HPC 04 -36: Complainant alleged that when he called the police station, officers slammed <br />the phone on him. Vice Chair Manago motioned to not sustain the complaint. <br />Commissioner Bertsch seconded the motion, and it carried unanimously. <br />HPC 04 -37: Complainant alleged that an officer told him he would be arrested for fighting <br />and called him a drug dealer. Commissioner Bertsch motioned to defer the complaint until <br />additional police reports are received. Vice Chair Manago seconded the motion, and it <br />carried unanimously. <br />HPC 04 -38: Complainant alleged that from 1988 to 2004, officers have failed to perform <br />their duties when he made noise nuisance complaints.
