Hawaii County Police Commission <br />Regular Session Minutes <br />March 14, 2008 <br />Page 6 <br />Ms. Pelayo stated that a previous opinion by Deputy Corporation Counsel Takase was that if <br />they cannot get an affirmative quorum vote, it will be held over. Officer Castillo will be asked <br />to attend the next meeting. <br />HPC 08 -01: Complainant alleged that an officer failed to serve and protect when she <br />complained about a neighbor's dog on her property. Vice Chair Whittemore moved that there <br />was insufficient evidence to prove the complainant's allegations. Commissioner Morimoto <br />seconded the motion, and it carried unanimously. <br />HPC 08 -04: Complainant alleged that an officer operated a speed trap, was unethical, <br />demeaning, and unprofessional. <br />Discussion: <br />Kaoiwi: That speed limit has not changed. He said the officer set up a speed trap. <br />Morimoto: Regardless, he was speeding. <br />Whittemore: Asked if an officer has to show the laser reading when asked. <br />Chief: The officer is not compelled to show it. It is a judgment call for the officer. <br />Whittemore: He admitted to speeding. <br />Ashida: For their purposes, he says the officer was unethical, demeaning, and <br />unprofessional. <br />Pelayo: The officer called and said he couldn't be at meeting but did submit a written <br />response. <br />Whittemore: He likes having officers present to see their demeanor. He said when he turned <br />around and came back, the officer was ticketing another person. That shows he was not <br />being targeted. <br />Commissioner Kaoiwi moved that there was insufficient evidence to prove the complainant's <br />allegations. Commissioner Morimoto seconded the motion, and it carried unanimously. <br />HPC 08 -06: Complainant alleged that during a traffic stop by an on -duty officer, a second <br />officer not in uniform, threatened him and struck his car with his hand and dented it. The <br />second officer then tried to take the laser gun from the on -duty officer. While this was <br />happening, complainant drove away. <br />Ms. Pelayo stated that complainant requested deferral to a Hilo meeting. It will be deferred. <br />HPC 08 -07: Complainant stated that they were stopped for driving through a red light. She <br />alleged that an officer pulled the driver out and about four officers manhandled him and put <br />
