Hawaii County Police Commission <br />December 18, 2009 <br />Page 4 <br />EXECUTIVE SESSION <br />Commissioner Politano Steckel moved to meet in executive session to consider discipline and <br />charges against officers or employees of the Hawaii County Police Department where <br />consideration of matters affecting privacy will be involved, to discuss the evaluation of an <br />employee, and to consult with Corporation Counsel on questions and issues pertaining to the <br />commission's powers, duties, privileges, immunities, and liabilities pursuant to HRS 92 -5 (2) <br />(4) and Hawaii County Charter Section 13 -20 (b). Commissioner Mende seconded the <br />motion, and it carried unanimously. <br />Executive session convened at 10:00 a.m. <br />Regular session reconvened at 2:30 p.m. <br />ACTION ON EXECUTIVE SESSION MATTERS <br />HPC 09 -15: Complainant alleged that helicopters were flying around in violation of the <br />Lowest Law Enforcement Priority of Cannabis Ordinance. <br />HPC 09 -17: Complainant alleged that DEA in helicopters conducted low -level marijuana <br />surveillance. <br />Commissioner Sumja moved to defer Complaints HPC 09 -15 and 09 -17 for 90 days and <br />ask the County Council for clarification on the ordinance. Commissioner Morimoto <br />seconded the motion, and it carried unanimously. <br />HPC 09 -36: Complainant alleged that during a fight at Shipman Park, an officer did not <br />mace the guys like she told him to, and so the fight escalated. Commissioner Morimoto <br />moved that there was insufficient evidence to prove the complainant's allegations. <br />Commissioner Politano Steckel seconded the motion, and it carried unanimously. <br />HPC 09 -39: Complainant alleged that during a traffic stop, an officer told him he would <br />give him a break on the citations, but the officer cited him anyway. Vice Chair Kaoiwi <br />moved that there was insufficient evidence to prove the complainant's allegations. <br />Commissioner Morimoto seconded the motion, and it carried unanimously. <br />HPC 09 -42: Complainant alleged that an officer lied about talking to his neighbor. <br />Commissioner Sumja moved that there was insufficient evidence to prove the <br />complainant's allegations. Commissioner Politano Steckel seconded the motion, and it <br />carried unanimously. <br />HPC 09 -46: Complainant stated that she called the police because a party, whom she had <br />an expired TRO against, had yelled at her from across the street. She alleged that the <br />responding officer told her to leave town and stay out of town. Commissioner Politano <br />Steckel moved that there was sufficient evidence to prove the complainant's allegations of <br />misconduct. Commissioner Sumja seconded the motion, and it carried unanimously. <br />HPC 09 -49: Complainant alleged that officers interrogated him in an improper and <br />abusive manner. Vice Chair Kaoiwi moved that there was insufficient evidence to prove <br />
