Hawaii Police Commission <br />Regular Session Minutes <br />January 28, 2011 <br />Page 4 <br />overall cost seems to have gotten out of hand. It is out of sight from the highway. The <br />firing range has cost issues and concerns of whether it could be in a more centralized <br />location, and outdoors. <br />Vice Chair Victorine stated that his affiliation with the police department goes back many <br />years. There are many different control factors that the firing range has to go through. For <br />instance, the Hilo station that has a firing range upstairs, has problems because of <br />ventilation. They are building the South Kona station with all concerns being considered. <br />Regarding centralization, Ka'u and Waimea will be using it. He is all for it. <br />Recess was called at 9:55 a.m. The meeting reconvened at 10:10 a.m. <br />EXECUTIVE SESSION <br />Commissioner Ono moved to meet in executive session to consider discipline and charges <br />against officers or employees of the Hawaii Police Department where consideration of <br />matters affecting privacy will be involved and to consult with Corporation Counsel on <br />questions and issues pertaining to the commission's powers, duties, privileges, immunities, <br />and liabilities pursuant to HRS 92 -5 (2) (4) and the Hawaii County Charter Section 13 -20 <br />(b). Commissioner Whittemore seconded, and it carried unanimously. Executive session <br />convened at 10:11 a.m. <br />Regular session reconvened at 2:05 p.m. <br />ACTION ON EXECUTIVE SESSION MATTERS <br />• Complaint HPC 10 -34: Complainant was involved in a vehicle accident and then <br />arrested for driving under the influence of intoxicants. He complained about the <br />process during his arrest. The complaint was withdrawn. <br />Complaint HPC 10 -37: Complainant was arrested for disorderly conduct. She alleged <br />that there was no need for the arrest, that the officers used unnecessary force, that she <br />was not read her rights, and that she was assaulted by another prisoner while in the jail <br />cell. She alleged misconduct by the responding officers. Vice Chair Victorine moved <br />that there was sufficient evidence to prove allegations of misconduct on Officer #1 only <br />and to refer the complaint to the Chief for further investigation by Internal Affairs. <br />Commissioner Whittemore seconded, and it carried unanimously. <br />Complaint HPC 10 -38: Complainant was cited for speeding. He alleged that he was <br />not doing what the officer said he was doing, and that he was intimidated and harassed <br />by the officers. Commissioner Sumja moved to refer the complaint to the Chief for an <br />investigation by Internal Affairs. Commissioner Whittemore seconded, and it carried <br />unanimously. <br />Complaint HPC 10 -39: Complainant alleged that officers ignored his complaint of a <br />TRO violation, and that officers have verbally abused him.
