Background <br /> 1. Oceanside, as developer of the subdivision called Hokuli'a, successfully <br /> sought passage of Hawaii County Council Ordinances 96-7 and 96-8 <br /> (January 15, 1996). These ordinances in pertinent part rezoned 1550 <br /> acres of the project to allow for the development of the planned <br /> subdivision, subject to certain conditions. <br /> 2. A condition of rezoning Ordinance 96-7 provided for Oceanside <br /> agreeing to construct a bypass highway in the vicinity of Keauhou and <br /> Captain Cook that would connect the subdivision to the Mamalaoha <br /> Highway, construct the channelization and signalization of the <br /> Mamalahoa Highway-Haleki`i Street Intersection, construct the <br /> extension of Haleki`i Street, construct a park, grant a perpetual <br /> • easement for public access, gain water rights, construct wastewater <br /> disposal systems, place most electrical and communication utilities <br /> Hawaii County is an Equal Opportunity Employer and Provider <br />
