The original Petition did not satisfy Planning Rule 3-2's requirements because it <br /> contained only a one-sentence request for a hearing without any of the required supporting <br /> material or reasoning. Petitioner supplemented its request by letters dated February 13, 2024, <br /> and April 25, 2004. Petitioner states a public hearing is "necessary to protect the rights of <br /> interested persons and to ensure a consistent disposition of all the issues presented across the <br /> three filings." Pet.'s April 24, 2024-letter. <br /> Petitioner did not give any clear indication of how the"rights of interested <br /> persons"will be protected by a public hearing aside from their statement that "a public airing of <br /> the issues will provide Planning Director with a fulsome appreciation of the facts on the ground." <br /> Id. Petitioner has had ample opportunity to provide the Director with any material or <br /> information which Petitioner feels is missing from the extensive existing written record, <br /> including Petitioner's own Petition and exhibits. <br /> Thus, the Director finds Petitioner has failed to establish why a public hearing, <br /> including presentations by the competing teams of attorneys of the information, history, and <br /> arguments found in the Petition and Oceanside's Petition, is necessary to permit the fair and <br /> expeditious disposition of the Petition, Given the extensive written records on this matter, the <br /> well documented Petition and the Oceanside Petition concurrently under the Director's review, <br /> Petitioner's request for a public hearing pursuant Planning Rule 3-2 is denied. <br /> Pursuant to Planning Rule 3-6, this Order shall not be applicable to different factual <br /> situations or where additional facts not considered in this Order exist. <br /> So Ordered, April 29, 2024 <br /> Zendo kern <br /> Zendo Kern;Apr 29,2024 15:26 HST) <br /> ZENDO KERN, PLANNING DIRECTOR <br /> 13 <br /> EXHIBIT A 906 <br />
